Income taxes are no longer due on April 15 in any US state

New Delhi, Dec 16 () The CBDT on Monday issued an order extending till December 31 the deadline for paying the third installment of advance tax payments for northeastern states in view of the Internet clampdown due to protests there against the amended Citizenship Act.
The set deadline was Sunday, December 15.
"Considering the large-scale disruption of Internet services in north eastern states-- Assam, Tripura, Arunachal Pradesh, Meghalaya, Nagaland, Manipur and Mizoram- the Central Board of Direct Taxes, in exercise of powers conferred under clause (a) of sub-section (2) of section 119 of the Income-tax Act, 1961, has decided to extend the last date for payment of December installment of advance tax for financial year 2019-20, from December 15, 2019 to December 31, 2019 in case of all assessees, corporate and other than corporates, in the above mentioned states," the notification issued on Monday said.
 As per section 208 of the I-T Act, every person whose estimated tax liability for the year is Rs 10,000 or more, is supposed to pay his tax in advance, in the form of advance tax. 
 Advance tax payments, under direct taxes category, are to be made four times in a financial year-- June 15 (15 per cent of advance tax), September 15 (45 per cent of advance tax paid), December 15 (75 per cent of advance tax paid) and March 15 (100 per cent of advance tax paid).

Advance tax payment deadline for NE states extended to Dec 31: CBDT

New Delhi, Mar 24 () Giving relief to citizens unable to meet deadlines due to coronavirus outbreak, Finance Minister Nirmala Sitharaman on Tuesday said the last date for filing of income tax return for FY2018-19 has been extended to June 30. Also, interest rate on delayed payment has been cut to 9 per cent from 12 per cent, she told reporters here. The government has also extended the last date for linking PAN with unique biometric ID Aadhaar to June 30 from March 31. Giving details of the extension of dates to help citizen cope with the lockdown, she said the Vivad se Vishwas tax dispute resolution scheme has been extended by three months to June 30. Those availing the scheme by the extended deadline will not have to pay 10 per cent interest on the principal amount. <ul class="summary-list"><li>The <keyword id="6359816" type="UNKNOWN" weightage="60" keywordseo="irs">IRS</keyword> is aiming to issue refunds to people who already paid taxes on some <keyword id="156351" type="PERSON" weightage="60" keywordseo="unemployment-insurance">unemployment insurance</keyword>.</li><li>It thinks it can "automatically issue refunds associated with the $10,200," the IRS chief said.</li><li>The IRS recently extended the tax-filing deadline from April 15 to May 17 for people.</li></ul>The IRS chief said during a congressional hearing on Thursday that the agency was taking steps to issue refunds for people who paid taxes on their first $10,200 in jobless aid.IRS Commissioner Charles Rettig urged taxpayers to refrain from filing an amended return. Instead, the organization is aiming to distribute refunds soon."We believe we will be able to automatically issue refunds associated with the $10,200," Rettig told the House Ways and Means Committee. He added he expected a formal announcement "in the near future."The commissioner was referring to a part of President Joe Biden's stimulus law that provides tax relief for unemployed workers. The IRS is moving to issue refunds for Americans who paid taxes on $10,200 in unemployment benefits last year

Mumbai, Mar 25 () Taxation experts have welcomed the measures announced by the government, saying these steps will add up to 2-3 per cent of GDP but will go a long way in addressing the issue of liquidity and deferment of payment obligations.The government on Tuesday came out with a slew of relaxation in tax and payment compliances by reducing the quantum of penalties, extending the deadline to make clear the dues among others to help the public and corporates.Some of the key measures include extension of tax filing/returns and accordingly all tax due arising between March 20, 2020 and June 29, 2020 now stand extended to June 30, 2020. This is across income tax and GST, and would apply to all return filings, replies/appeal filings, and other compliance documents. For delayed payments, interest rates have been reduced to 9 per cent under both income tax and GST.Welcoming the measures, Deloitte said these measures will help ease the compliance pressure on businesses and individuals and provide necessary relief to critical sectors in view of the Covid outbreak. Many analysts have said the lockdowns will shave off as much as Rs 9 lakh crore of the GDP.Gokul Chaudhri of Deloitte India said, "These steps will certainly give a lot of confidence to corporates and different sectors of the economy. The relief measures and easing of compliance deadlines will enable businesses to sustain themselves in the current atmosphere and is likely to have a positive impact on economic activities and more importantly remove uncertainty in the system."From the tax point of view, the reliefs like tax breaks, accelerated depreciation, reliefs on payrolls, payments-weighted deduction, relief on contribution to PF will add up to 2-3 percent of GDP, which is much needed to help address the issue of liquidity and deferment of payment obligations," he said.The move to ensure 24/7 trade facilitation at ports through the customs will not only promote ease of doing business but also ensure smooth flow of trade, he added.Jiger Saiya, partner and leader for tax and regulatory services at BDO India, said the extension to the Vivad Se Vishwas scheme will go a long way in making the entire scheme a success as in the original form it was an impossibility to attain the objective."With the extension, taxmen will now have time to clarify more aspects and taxpayers will have reasonable time to evaluate and seek settlement of tax disputes, under the scheme," Saiya said.Veena Sivaramakrishnan of Shardul Amarchand Mangaldas &amp; Co said the tax measures are a step in the right direction and indicate more such practical measures to come in the future.KPMG India's Rajeev Dimri said the various tax reliefs announced by the finance minister would provide the much needed succor to all in these unprecedented times.Naveen Aggarwal of KPMG said extension of the deadline under Vivad Se Vishwas from March 31 to June 30 without paying additional tax of 10 per cent is a welcome move and is in line with the representations made by taxpayers and industry forums. This would help companies save for possible financial difficulties faced by companies in this crises.On the IBC changes, Manish Aggarwal of KPMG said changing the operative sections of the IBC will help avoid large scale insolvencies.The government also needs to consider sector specific measures to address the cash flow &amp; liquidity enhancement measures to help businesses withstand this period. Covid-driven tax reliefs to cost govt 2-3% of GDP

<ul><li>The deadline for <keyword id="4596360" type="PERSON" weightage="20" keywordseo="pan-aadhar-linking">PAN-Aadhar linking</keyword> has been extended to 31 March 2019. </li><li>It might have been done because the Supreme Court supported the activists’ argument to push back the deadlines. </li><li>Despite the fact that the deadline has been extended for the fifth time, only about 16.65 crore out of the 33 crore existing PANs have been linked with Aadhaar up till March this year. </li></ul> The <keyword id="121964" type="ORGANIZATION" weightage="20" keywordseo="Central-Board-of-Direct-Taxes">Central Board of Direct Taxes</keyword> (CBDT) has issued an order under Section 119 of the Income Tax Act, stating that the deadline for PAN-Aadhar linking has been extended to 31 March 2019. The announcement was made this Saturday night, just a few hours before the end of the previous deadline. Despite the fact that the deadline has been extended for the fifth time, only about 16.65 crore out of the 33 crore existing PANs had been linked with Aadhaar, up till March this year. The earlier deadlines for the PAN-Aadhar linking were 31 July, 31 August and 31 December 2017 followed by 31 March and 30 June of this year. India had launched Aadhaar back in 2009 and it has now become the world's biggest biometric database. Section 139AA of the Income Tax Act, 1961, which came into effect from 1 July 2017, mandated that all taxpayers having an Aadhaar card must link it with their PAN. The biometric card would also be required to file income tax returns and to get a new <keyword id="74488" type="ORGANIZATION" weightage="20" keywordseo="PAN-card">PAN card</keyword>. The provision was incorporated to check tax evasion through the use of multiple PAN cards. Activists have challenged the validity of the Aadhaar law, claiming that linking their <keyword id="155319" type="COMPANY" weightage="20" keywordseo="Aadhar">Aadhar</keyword> card for various purposes put their privacy at stake and thereby, violated their fundamental Right to Privacy. They also argue that Aadhar linking leaves room for misuse of their fingerprint and iris scans. The activists had filed petitions and moved court against this law. The five judges hearing the petitions had concluded the case in May but have not yet delivered the ruling regarding whether Aadhaar should be made mandatory for welfare schemes and financial transactions, or not. CBDT said that the announcement for extending the deadline has been made after "consideration of the matter". However, it seems that it was done because the Supreme Court, which has heard several petitions against the Aadhaar law, had supported arguments to push back the deadlines before the court gives a final verdict. Deadline for PAN-Aadhar linking extended for a fifth time, new date is 31 March 2019

 In the past, when such incidents took place, the government at least offered an explanation as to why. Just last year it was due to the fact that the PAN and Aadhaar cards hadn’t been linked yet. The year before that it was a strike followed by a holiday. In fact, in 2015, the deadline was extended twice.The first time it was due to the fact that forms had changed and the second time was due to the slowdown of e-services. There was some confusion over what the <keyword id="47209" type="ORGANIZATION" weightage="20" keywordseo="Finance-Ministry">Finance Ministry</keyword> means by ‘said categories’ without specifying any categories whatsoever. But consensus dictates that the same categories of taxpayers that had to file their returns by July 31, will now be able to do so till August 31. Enforcing deadlines Until last year, there wasn’t any penalty issued for filing an ITR late but for 2018-19, there’s a new addition to the Income Tax Act. Section 234F states that in due dates are violated than an individual would have to pay a fine of up to Rs 10,000. That being said, if an individual’s income is less than Rs 500,000, if a late fine is incurred it won’t be anymore than Rs 1,000. <div type="image" title="ITR" msid="65165660" hostid="261"></div>

(Eds: Adding details) New Delhi, Mar 24 () The government on Tuesday extended the deadline for filing income tax and GST returns, raised threshold of default that could trigger insolvency of a company and waived charges on cash withdrawals from ATM of other banks as a precursor to a broader stimulus package for the economy distressed by the coronavirus outbreak.The last date for filing income tax returns for 2018-19 as well as that for linking PAN with biometric ID Aadhaar has been extended by three months to June 30. The last date for filing GST annual returns for last fiscal, which is due on March 31, has also been extended till the last week of June. As the outbreak of the Covid-19 pandemic and the lockdowns across cities create large scale economic disruption, Finance Minister Nirmala Sitharaman announced that the threshold of loan default that could trigger insolvency proceedings has been raised to Rs 1 crore from the existing Rs 1 lakh now. "This will by and large prevent triggering of insolvency proceedings against small, micro and medium enterprises (MSMEs)," she said at a news conference. "If the current situation continues beyond April 30, 2020, we may consider suspending Section 7, 9 and 10 of the Insolvency and Bankruptcy Code (IBC) 2016 for a period of 6 months so as to stop companies at large from being forced into insolvency proceedings in such force majeure causes of default." With lockdowns restricting movements, the government waived a minimum balance fee on the savings bank account as well as allow charge-free withdrawals from any bank ATM for three months. Also, bank charges for digital trade transactions for all trade finance consumers have been reduced. For companies, it relaxed mandatory requirement of holding meetings of the board of directors by 60 days and waived the fee for late filings during the moratorium period. Stating that the announcements done on Tuesday were to ease the burden of compliance on citizens during the lockdown period, Sitharaman said an economic relief package was in works and it will be announced "sooner rather than later". "Every attention is being given to the economy. The Prime Minister himself is closely monitoring the situation," she said adding multi-layered composition of the Covid-19 Economic Task Force, announced by the Prime Minister last week, is already working. Inputs from sub-groups of the task force on various sectors of the economy are being analysed in detail. "And as I said, the economic package is being worked out. And as I said earlier, sooner we shall come with an announcement on that," she said. "The work of the task force which is multi-layered is already almost intensively nearing a conclusion. So, the task force based report and the action following the task force's report are almost at its peak. And that is why I have said, we will announce the economic package sooner rather than later." "Work is going on we are very close to announcing economic package," she said.The measures announced included an extension of the deadline for the tax settlement scheme, Vivad se Vishwas, to June 30, 2020, along with some other income tax filing requirements. The extension of timelines for GST returns for three months -- March to May, to the end of June without any late fees, penalty and interest for enterprises with turnover less than Rs 5 crore will provide significant relief for SMEs who are likely to be subject to intense liquidity pressures. While the extension of default threshold for IBC applicability from Rs 1 lakh to Rs 1 crore will act as a protection for MSMEs in the current crisis period and further, the intent to suspend creditor rights on corporate insolvency for a temporary 6-month period was also hinted by the finance minister. This will arrest any possible move by lenders to proceed under IBC in a scenario where corporate asset quality has already seen stress due to the continuing economic slowdown and is being further aggravated by the Covid-19 led lockdown. Also, due dates for notices as well as investment in saving instruments or investments for rollover benefit of capital gains under the Income Tax Act were extended to June 30. For delayed payments of advanced tax, self-assessment tax, regular tax, TDS, TCS and STT, a reduced interest rate of 9 per cent instead of 12/18 per cent will be charged for this period. No late fee/penalty shall be charged for the delay. Goods and Services Tax (GST) returns for the month of March, April and May can now be filed by last week of June with no interest, late fee and a penalty for companies with less than Rs 5 crore turnover. Others can file GST returns for these months by last week of June but the same would attract a reduced rate of interest of 9 per cent per annum from 15 days after the due date (current interest rate is 18 per cent per annum). Govt extends tax deadlines, waives ATM charges, relaxes insolvency norm ahead of eco stimulus

You do not need to lose sleep anymore if you have missed the July 31 deadline for filing the <keyword id="101261" type="UNKNOWN" weightage="100" keywordseo="I-T-return">I-T return</keyword>. The government has extended the deadline for filing the returns till 31 March 2015 – the last day of FY2014-15. Moreover, there is no penalty for filing the return late if all your taxes have been paid. 
 
Even if they miss the 31 March, 2015, deadline too, they can still file their return by 31 March, 2016. But this will be considered as a belated return. There is no difference in the filing procedure before or after the deadline but you need to mention that the return is a belated one in the tax form. There could also be a fine of Rs 5,000 for late filing, depending on the discretion of the assessing officer. 
 
However, as per tax experts, the fine is rarely imposed if all the taxes have been paid. The assessing officer invokes that provision only when there is an additional tax liability.

What is a belated return? People who have not filed an income tax return before the due date are still eligible to file belated return any time during the current assessment year 2019-2020. The Penalty However filing belated returns comes with late fee and certain restrictions. The Income Tax department is going to levy a penalty of ₹5000 in case you file your return before 31 December of assessment year and ₹10,000 if the return is filed between January 1 and March 31. Further, people below the income of ₹5 lakh per annum will not be charged more than ₹1,000. The penalty is required to be submitted before the belated return. The Income Tax will levy a penalty irrespective of whether there is any tax due or not. Besides the penalty, you will also be required to pay interest on taxes for all the months till you file ITR. And in case you forget to file your ITR at all, then the IT department is going to send you a notice to conduct legal proceedings. This can include jail term between three months to two years. The jail term can go as high as seven years if the tax is more than ₹25 lakh.

New Delhi, Jan 8 () Finance Minister Nirmala Sitharaman on Monday said the government will consider an extension in the deadline for availing the lower 15 per cent corporate tax rate on new investments, due to the COVID-19 pandemic. In the biggest reduction in 28 years, the government in September last year slashed corporate tax rates by up to 10 percentage points to attract private investment and push sagging economic growth. Base corporate tax for existing companies was reduced to 22 per cent from 30 per cent, and to 15 per cent from 25 per cent for new manufacturing firms incorporated after October 1, 2019, and starting operations before March 31, 2023. "I will see what can be done. We want industry to benefit from the 15 per cent corporate tax rate on new investments and I take your point for considering an extension in the deadline of March 31, 2023," Sitharaman said. Addressing members of FICCI, the minister assured the industry of all possible government support with the intent of supporting Indian business and reviving the economy. Sitharaman clarified that the COVID-19 Emergency Credit Facility covers all companies and not just micro, small and medium enterprises (MSMEs). On the question of liquidity, she said, "We have fairly clearly addressed the issue of liquidity. There is definitely the availability of the liquidity. We will look into it if there are still issues." She also said every government department has been told to clear dues and if there is any issue with any department, the government will look into it. The finance minister also said the government will consider an extension in the deadline for availing the 15 per cent corporate tax rate on new investments. The minister suggested the industry to submit their recommendations related to the ministry of corporate affairs or Sebi deadlines so that necessary steps could be taken. With regard to the need for reduction in GST rates in the badly affected sectors, She said, "GST rate reduction will go to the Council. But, the GST Council is also looking for revenue. The decision for reduction in rate for any sector has to be taken by the Council."
