Following two incidents of passenger misconduct in the <keyword id="2573" type="General" weightage="100" keywordseo="air-india" source="Orion">Air India</keyword> Paris-New Delhi flight on December 6, 2022, aviation regulator DGCA has asked the airline to maintain a database of all unruly passengers. It also asked the airline to refer the incident to the internal committee which will decide the duration of ban for flying of the unruly passenger within 30 days and thiscan extend from zero day to lifetime ban. Two incidents of passenger misbehavior occurring on Air India flight AI-142 on December 6, 2022 from Paris to New Delhi, came to the notice of the DGCA. One passenger was caught smoking in the lavatory, was drunk and not listening to the crew. Another passenger allegedly relieved himself on a vacant seat and blanket of a fellow female passenger when she went to the lavatory. A senior DGCA official said that the airline concerned shall refer the incident to the internal committee comprising three members including a retired district and session judge as Chairman, a representative from a different scheduled airline as member, and representative from a passengers association or consumer association or retired officer of the <keyword id="687497" type="General" weightage="50" keywordseo="consumer-dispute-redressal-forum" source="Orion">Consumer Dispute Redressal Forum</keyword> as member. During the pendency of the decision by the Internal Committee, the concerned airline may ban such unruly passengers from flying for a period not exceeding 30 days, said the DGCA official on Monday. After the decision of the Internal Committee, the airline shall maintain a database of all such unruly passengers and inform the same to the DGCA who is the custodian for maintaining the"No-Fly List". "It may be noted that the period for which an unruly passenger can be put on 'No-Fly List' is the sole decision of the internal committee of the airline concerned," said the regulator. The DGCA on Monday said that the response of Air India has been "lackadaisical and delayed" with regard to the two incidents of passenger misbehaviour occurring on Air India flight AI-142 on from Paris to New Delhi on December 6, 2022. The DGCA on Monday said that Air India didn't report the incident until the regulator sought the incident report from them on January 5. "After perusal of the reply submitted by M/s Air India through email dated January 6, prima facie it emerges that provisions related to handling of an unruly passengers as per DGCA CAR Section 3, Series-M, Part-VIA have not been complied with. It has been noted that the response of the airline has been lackadaisical and delayed," it said.

Taking note of the <keyword id="2573" type="General" weightage="100" keywordseo="air-india" source="Orion">Air India</keyword> urination case, the <keyword id="6354705" type="General" weightage="50" keywordseo="directorate-general-of-civil-aviation" source="Orion">Directorate General of Civil Aviation</keyword> has imposed a financial penalty of Rs 30 lakh on the airline, <keyword id="6354787" type="General" weightage="80" keywordseo="dgca" source="Orion">DGCA</keyword> officials said on Friday. The aviation regulator also has suspended the license of the Pilot-In-Command of the flight for the period of three months. According to the DGCA's notification, the license of the Pilot-In-Command has been suspended for a period of three months for failing to discharge his duties as per Rule 141 of the Aircraft Rules, 1937, and applicable DGCA Civil Aviation Requirements. "Financial Penalty of Rs 30,00,000 (Rupees Thirty Lakh only) has been imposed to M/s Air India for violation of applicable DGCA Civil Aviation Requirements," it further said. The Director-in-flight services of Air India have also been slapped with a financial penalty worth Rs 30 lakh for failing to discharge her duties as per applicable DGCA Civil Aviation Requirements. "DGCA issued Show Cause notices to the Accountable Manager of M/s Air India, the Director of in-flight Services of M/s Air India, and all the pilots and cabin crew members of that flight as to why enforcement action should not be taken against them for dereliction of their regulatory obligations. The written reply of M/s Air India and the personnel involved were examined," the DGCA said in the statement adding that these actions have been taken in the instant case according to the written response of the airline. On November 26 last year, a man named <keyword id="290030" type="General" weightage="50" keywordseo="shankar-mishra" source="Orion">Shankar Mishra</keyword> allegedly urinated on a 70-year-old woman in an intoxicated condition in business class of an Air India flight. Delhi Police had registered a First Information Report (FIR) against him on January 4 on a complaint given by the woman to Air India under sections 354, 509, and 510 of the Indian Penal Code (IPC) and Section 23 of the Indian Aircraft Act. Both the accused and the victim are from outside Delhi. US-based financial services company <keyword id="88858" type="General" weightage="50" keywordseo="wells-fargo" source="Orion">Wells Fargo</keyword> also terminated its employee Shankar Mishra after the incident. "Wells Fargo holds employees to the highest standards of professional and personal behaviour and we find these allegations deeply disturbing. This individual has been terminated from Wells Fargo. We are cooperating with law enforcement and ask that any additional inquiries be directed to them," the company said in a statement. Air India urination case: DGCA slaps Rs 30 lakh penalty on AI, suspends pilot's licence for 3 months

<keyword id="2573" type="General" weightage="20" keywordseo="air-india" source="Orion">Air India</keyword>'s handling of an incident in which an inebriated male flier allegedly urinated on a woman co-passenger suggests an urgent need for stricter rules to deal with <keyword id="128966" type="General" weightage="20" keywordseo="unruly-passengers" source="Orion">unruly passengers</keyword>, according to legal and aviation experts. Instances of inappropriate conduct on <keyword id="6367662" type="General" weightage="20" keywordseo="flights" source="Orion">flights</keyword> have gone up in the recent past because airlines try to cover up such incidents due to their commercial interests, the experts said. According to police, the male passenger, Shankar Mishra, allegedly urinated on a woman co-passenger in her 70s in the business class of the Air India flight from New York to Delhi on November 26 last year. Delhi Police registered an FIR against him on January 4 on a complaint given by the woman to Air India and arrested him from Bengaluru on Saturday. To prevent such incidents in future, the experts said, the Civil Aviation Requirements (CAR) of 2017 for handling of unruly passengers should be amended. The Directorate General of Civil Aviation (DGCA) framed the rules in 2017 after the then Shiv Sena MP Ravindra Gaikwad assaulted an Air India staff member. Under these rules, unruly behaviour by a passenger onboard a flight is a punishable offence. Supreme Court lawyer Ujjawal Anand Sharma said lodging an FIR in all cases of unruly behaviour by passengers onboard flights should be made compulsory under CAR, 2017. "I think there is a need to amend it (CAR, 2017) and make it compulsory to lodge an FIR in all cases of unruly behaviour onboard (flights) irrespective of the level of seriousness (of the offence)," said Sharma, who had represented stand-up comedian Kunal Kamra in the alleged unruly behaviour case in the Delhi High Court. Sharma, who is also a Partner at Lawmen &amp; White law firm, said, "It should be made part of the SoP (standard operating procedure) to inform the local police after the aircraft lands. Also, I believe that instead of an internal committee of an airline, there should be an independent committee under the DGCA which should be informed about every case of unruly behaviour." This will also help airlines avoid allegations of hushing up the matter. According to CAR, 2017, the captain and the crew of a flight are supposed to inform the airline about a passenger's unruly behaviour once the aircraft lands at its destination airport. The airline will present the case before its internal committee which comprises a retired district session judge and two independent members. "Pending decision of the Internal Committee, the concerned airline may ban such unruly passenger from flying, but such period may not exceed a period of 30 days," the rules state. According to the rules, "The Internal Committee shall give the final decision in 30 days by giving the reasons in writing. The decision of the Internal Committee shall be binding on the airline concerned. In case the Internal Committee fails to take a decision in 30 days, the passenger will be free to fly." CAR, 2017 grades offences into three categories and once the internal committee decides the level of offence and imposes a ban on the passenger, the decision has to be communicated to the DGCA/other airlines and the person should be put on the no-fly list. Such a passenger can be banned for a minimum of three months in case of a level 1 offence and a maximum of two years for a level 3 offence. The rules necessitate lodging an FIR only in extreme cases of aggressive behaviour by a passenger which may cause the aircraft to make an emergency landing. Nishant Kr. Srivastava, a criminal lawyer and Founder of Actus Legal Associates &amp; Advocates, said an unruly passenger should be barred from flying with any airline till the inquiry is pending. "The present norms say that an unruly passenger will be banned from flying for 30 days till the Internal Committee of that particular airline decides his/her case. Meanwhile, he can fly with other airlines. It should be made more deterrent by banning him from flying with any airline," he said. Mohit Chand Mathur, a senior advocate in the Delhi High Court, underlined the need for timely implementation of the existing legal provisions to avoid a repeat of such incidents. On January 5, the DGCA pulled up the Tata Group-owned Air India, saying prima facie it emerges that provisions related to handling of unruly passengers were not complied with. It said Air India's conduct appeared to be "unprofessional". A US-based doctor who was seated next to the accused spoke out about the November 26 incident, alleging the flight crew showed "no compassion" and failed in their responsibility on several counts as they made the woman talk to the man after his "indecent exposure" and she was made to go back to her soiled seat. Aviation professionals also stressed the need for stricter punishment to bring down instances of unruly behaviour by passengers. "It is the responsibility of the government and the industry to impose and implement strict rules against such offenders," said Sharad Kumar, director, Chennai Airport. Crew members should be better trained to handle such situations, he said. "The male passenger (who urinated on his co-passenger on the Air India flight) should be banned across airports. He should not be allowed to enter any airport for at least a year," said industry expert R Ramkumar. Air India has issued show cause notices to four cabin crew and one pilot of its New York-Delhi flight and de-rostered them pending investigation. The airline's CEO and Managing Director Campbell Wilson said on Sunday that "we fell short of addressing this situation the way we should have". He said the airline will "review and repair every process to prevent or address any incidents of such unruly nature". Air India urination: Experts seek harsher punishments for unruly behaviour on flights

The Directorate General of Civil Aviation (DGCA) plans to ramp up its technical staff to 1,100 by hiring another 400 people in the next one to two years as well as increase the number of offices to 19 as the watchdog strengthens the safety oversight capabilities, according to its chief <keyword id="26593" type="General" weightage="100" keywordseo="arun-kumar" source="Orion">Arun Kumar</keyword>. Kumar, who will be superannuating on February 28 after being at the helm for nearly four years, described his tenure as a "roller coaster ride" during which various steps were taken to improve aviation safety and the regulator also dealt with multiple headwinds, including engine issues and safety concerns over <keyword id="6358032" type="General" weightage="50" keywordseo="spicejet" source="Orion">SpiceJet</keyword>. <keyword id="3658" type="General" weightage="80" keywordseo="india" source="Orion">India</keyword>'s aviation safety oversight ranking jumping to the 55th position from 112th place earlier under the International Civil Aviation Organization (ICAO) coordinated validation mission, rollout of eGCA for processes at the regulator, introduction of regulations for transgenders who want to be pilots as well as compulsory breath analyser tests for air traffic controllers are among the key developments during the tenure. "The country's aviation safety oversight capability has improved substantially and DGCA in its annual surveillance programme conducts more than 4,000 spot checks/audits/night surveillance," Kumar told PTI in an interview. Currently, the Directorate General of Civil Aviation (DGCA) has around 1,300 employees, including about 700 technical staff. "The number of technical staff is expected to increase by 400 in the next one to two years... also, the number of offices of the DGCA in different parts of the country will increase to 19 from the current 14 in the near term," he said. When asked about his tenure, Kumar, an IAS officer of the 1989 Haryana cadre, said it has been a "roller coaster ride". "It was fulfilling as we took various steps to improve aviation safety. eGCA was a game changer and made life easier for all stakeholders," he asserted. "Among the biggest achievements are India's position going up in the ICAO safety rankings and the full rollout of the eGCA. With the high ICAO ranking, the world knows that India is a better country when it comes to aviation safety," Kumar said. During the pandemic, the DGCA chief said that India did what other countries were doing and flight services were suspended for a considerable time. "What is significant is that our resumption was glitch free while others (countries) had air crash and accidents. DGCA is an expert agency and we have always taken pride in our professionalism. Aviation safety is a serious business and DGCA inspectors have always risen to the occasion," Kumar said. India is the world's third largest as well as the fastest growing civil aviation market in the world. "On an average, there are 4.5 lakh domestic air passengers and 1 lakh international air passengers in the country," Kumar said. In recent times, the regulator has also taken strict action in relation of unruly passenger behaviour onboard flights. Last month, in a span of less than a week, the DGCA had penalised Tata Group-owned <keyword id="2573" type="General" weightage="80" keywordseo="air-india" source="Orion">Air India</keyword> twice related to incidents of unruly passenger behaviour. On January 24, the regulator imposed a fine of Rs 10 lakh on the airline for not reporting two incidents of unruly passenger behaviour onboard a Paris-New Delhi flight on December 6, 2022. On January 20, the watchdog slapped a penalty of Rs 30 lakh on Air India as well as suspended the licence of the pilot-in-command of the New York-Delhi flight in which a person allegedly urinated on a female co-passenger on November 26, 2022. In connection with the incident, a fine of Rs 3 lakh was also imposed on Air India's Director of in-flight services for failing to discharge her duties.

Air India has also initiated internal investigations into whether there were lapses by other staff on other aspects, including the service of alcohol on flight, incident handling, complaint registration and grievance handling. In a statement, <keyword id="5863894" type="General" weightage="50" keywordseo="campbell-wilson" source="Orion">Campbell Wilson</keyword>, the CEO and Managing Director of Air India, said: "Air India is deeply concerned about the in-flight instances where customers have suffered due to the condemnable acts of their co-passengers on our aircraft. We regret and are pained about these experiences. "Air India acknowledges that it could have handled these matters better, both in the air and on the ground and is committed to taking action." The CEO said that the airline has initiated multiple steps with a view to materially strengthen and improve how such incidents would be addressed in future, which includes commencing a comprehensive education program to strengthen crews' awareness of and compliance with policies on the handling of incidents and unruly passengers, and to better equip crew to empathetically assist those affected, review of the airline policy on service of alcohol in flight and review the meeting frequency of the DGCA-prescribed "Internal Committee", tasked with assessing incidents, so that cases are assessed and decisions reached in a more timely manner. The steps also include improving the robustness of its legacy incident reporting processes, which are presently paper-based and manual, Air India signed a Letter of Intent in December 2022 to acquire a license for the market-leading provider of incident management software, <keyword id="15995247" type="General" weightage="50" keywordseo="coruson" source="Orion">Coruson</keyword>. In addition to this state-of-the-art software, the airline is also in the process of deploying iPads to Pilots and Senior Cabin Crew. When used together, crew will be able to enter voyage and incident reports electronically, which will then be rapidly and automatically routed to relevant parties including, as required, the Regulator. "When the Committee could not find an adequate explanation as to how the accused could have urinated on the complainant sitting on seat 9A without also affecting the passenger on Seat 9C, it has erroneously gone on to assume that there was a seat 9B in the business class in the aircraft and imagined that the accused could have stood at this imaginary seat and urinated on the complainant on seat 9A. However, there is no seat 9B in the business class on the craft - only seats 9A and 9C," the statement said. Lawyers said that based on these unfounded and clearly incorrect conjectures, the Committee has essentially manufactured a possibility that the accused had committed the alleged act. "This finding is particularly surprising considering that there were two aviation experts on the committee. We maintain the innocence of the accused and have full faith in the judicial system of the country," lawyers added. "The independent 3-member Internal Committee under the chairmanship of ex-District Judge has concluded that Shankar Mishra is covered under the definition of "unruly passenger" and banned from flying for 4 months as per relevant provisions of Civil Aviation Requirements," said an Air India spokesperson on Thursday.
