The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Thursday declined to postpone the GATE-2022 exam saying that postponement will create "chaos and uncertainty" in the lives of students who have registered for it. A bench headed by <keyword id="3360108" type="General" weightage="20" keywordseo="Justice-D-Y-Chandrachud" source="Orion">Justice D.Y. Chandrachud</keyword> and comprising <keyword id="12007072" type="General" weightage="20" keywordseo="justices-surya-kant" source="Orion">Justices Surya Kant</keyword> and <keyword id="177282" type="General" weightage="20" keywordseo="vikram-nath" source="Orion">Vikram Nath</keyword> said the court is not willing to entertain a petition 48 hours before the exam, as it will create chaos and uncertainty in the lives of the students who have already registered for the GATE-2022 exam. The bench was informed that over 9 lakh students are taking the GATE-2022 exam. The bench added that there is no overarching reason for it to exercise its jurisdiction under Article 32 of the Constitution, to supplant the duties and functions of the regulatory authorities who have taken a decision in connection with the schedule of the exam. The bench pointed out that now everything is opening up and it is not correct for courts to step into academic matters. The bench said: "We are not inclined to entertain a petition under Article 32...These petitions are accordingly dismissed." Advocate Satpal Singh, representing a petitioner, contended that many state governments have imposed a lockdown on weekends, and in this backdrop holding the exam is unfair and urged the court to defer the exam for a month. The bench told the petitioners counsel that some petitioners have moved before it and many others have already prepared for the exam. It pointed out that the exams were notified in August last year and 9 lakh are appearing for it, and 20,000 have signed an online petition. "Only authorities can look into this", said the bench. Justice Chandrachud queried the petitioners' counsel, "Look at the legitimacy of courts entering into these thickets. Just because some states have issues, how do we play with the careers of all students..." After a detailed hearing in the matter, the top court dismissed the pleas seeking postponement of the exam in the backdrop of third Covid wave. Supreme Court junks plea to postpone GATE-2022 exam

India's largest software services company <keyword id="6357585" type="CITY" weightage="100" keywordseo="Tata-Consultancy-Services">Tata Consultancy Services</keyword> (<keyword id="6357150" type="CITY" weightage="100" keywordseo="TCS">TCS</keyword>) has 91 employees in India who got paid more than Rs 1 crore in form of salaries in fiscal 2017, a number significantly higher than rivals <keyword id="6354512" type="CITY" weightage="100" keywordseo="Infosys">Infosys</keyword> and <keyword id="10862" type="CITY" weightage="100" keywordseo="Wipro">Wipro</keyword>. Out of these, 22 employees have spent their entire careers at the TCS. In comparison, Infosys has 51 executives who take home more than Rs 1 crore per annum, out of which about 16% started their careers with the Bengaluru-headquartered company. Wipro, on the other hand, has 61 such employees, out of which about 27% have been with it throughout their careers. "TCS is much bigger than Infosys or Wipro, and executive stability has been a defining factor for the company," an analyst with a Mumbai-brokerage told <a href="http://economictimes.indiatimes.com/tech/ites/tcs-way-ahead-of-of-the-field-in-race-of-crorepati-executives/articleshow/59673309.cms">ET</a>, requesting anonymity. "They also tend to promote from within. It is rare for an executive to come in from outside," he added. TCS employees who are stationed outside India could be earning significantly more because of being compensated in foreign currencies. The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Friday asked the Centre to make its stand clear on <keyword id="6395759" type="General" weightage="20" keywordseo="bitcoins" source="Orion">Bitcoins</keyword>. Currently, there is no regulation or any ban on the use of cryptocurrencies in the country. A bench comprising Justices D.Y. Chandrachud and Surya Kant told the additional solicitor general (ASG) Aishwarya Bhati, "You have to make your stand clear." The bench was hearing a plea by Ajay Bhardwaj against the Union of India. Bhati submitted before the bench that this case involves 87,000 Bitcoins and the accused is not cooperating with the investigation, and multiple summons have been issued so far. The bench queried, "Is it illegal or not..." Bhati replied: "We will do that my lord." Advocate Shoeb Alam, appearing for an FIR informant, sought cancellation of bail granted to Bhardwaj. The bench pointed out that a status report had been filed by the Enforcement Directorate in July last year. Bhati added that the accused has not cooperated in the probe. The bench directed the accused to meet with the investigating officer (IO) and cooperate in the investigation. The bench said the IO will file a status report showing the cooperation of the accused and scheduled the matter for further hearing after four weeks. The bench added that the interim order restraining arrest of the accused will continue till the next date of hearing. <keyword id="6358821" type="General" weightage="20" keywordseo="shiv-sena" source="Orion">Shiv Sena</keyword> chief whip Sunil Prabhu Wednesday alleged in the Supreme Court that Maharashtra Governor's direction to the Uddhav Thackeray-led Maha Vikas Aghadi (MVA) government to take a floor test in the Assembly on Thursday was "malafide, unconstitutional, and illegal." The plea challenging the Governor's direction was mentioned before a vacation bench of Justices Surya Kant and J B Pardiwala who took note of submissions of senior advocate A M Singhvi that an urgent hearing was needed and is scheduled to hear the matter at 5 pm. The petition contended that Governor Bhagat Singh Koshyari vide communication dated June 28, 2022 (which was received today i.e., on June 29 at about 9:00 am) has decided to hold a floor test in complete defiance of the fact that this court is seized of the issue of the disqualification proceedings. "Such undue haste is manifestly arbitrary and therefore violative of Article 14," said the plea and sought directions seeking setting aside of the impugned communication sent by the Governor to the Chief Minister as well as to the secretary of the Assembly. "It is submitted that this Court is considering the validity of the disqualification proceedings and has kept the matter for hearing on July 11, 2022. The issue of disqualification is directly connected/interlinked with the issue of floor tests. "It is submitted that the impugned communications are entirely based on media reports with no concrete material whatsoever. None of the 39 MLAs, it appears, have individually or collectively written to the Hon'ble Governor about their decision to withdraw support from the MVA-led government," the plea said. Prabhu submitted in his plea that the impugned directions ought not to have been issued without the aid and advice of the council of the ministers led by the Chief Minister. "It is surprising that the leader of the opposition admittedly meets the Governor at 10:00 pm on June 28, 2022, and the impugned communications are also of the same date. This only shows the undue haste with which the Hon'ble Governor has acted without even asking the CM for his views in respect of the political scenario in the State. "The impugned directions, it seems, have been issued on the 'aid and advice of the leader of the opposition, which is clearly not contemplated under the constitution," the plea said. The petition stated that there is absolutely no ground or material to call for an urgent floor test on June 30, 2022, when this court is already seized of parallel proceedings and wherein constitutional issues are to be decided. "The Governor with little or scant respect to the sanctity and dignity of this court has proceeded to go ahead and order a floor test in a clear attempt to shield the MLAs from the punishment entailed on account of the constitutional sin of defection. "The floor test, no doubt, is a constitutional mandate to ascertain who has the majority as our democracy is founded on the rule of the majority. An equally concomitant consideration and constitutional imperative in the Tenth Schedule of the Constitution which prescribes and outlines who can be entitled to vote or be a part of the Assembly," the plea said. Prabhu contended that the respondents in the disqualification petitions have already lost their membership on the day they voluntarily gave up their membership from Shiv Sena. "The disqualification proceedings under the Tenth Schedule are only a formal adjudication of this fact or otherwise of disqualification. The order of the Speaker/Deputy Speaker is an ex post facto recognition of the event of disqualification which had occurred at an anterior point of time," it said. Koshyari has asked the Maharashtra Legislature Secretary to hold a floor test of the <keyword id="8400868" type="General" weightage="20" keywordseo="MVA-government" source="Orion">MVA government</keyword> at 11 am on Thursday. Maha crisis: Sena calls floor test illegal and malafide

The <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Monday declined to entertain a plea by e-commerce giants <keyword id="18635" type="CITY" weightage="20" keywordseo="Amazon">Amazon</keyword> and <keyword id="6354742" type="COMPANY" weightage="20" keywordseo="Flipkart">Flipkart</keyword>, saying they must face inquiry by Competition Commission of India (CCI) for anti-competitive practices. A bench headed by Chief Justice <keyword id="2797471" type="PERSON" weightage="20" keywordseo="N-V-Ramana">N.V. Ramana</keyword> and comprising justices Vineet Saran and Surya Kant said: "Big organizations like you ( Flipkart and Amazon) should volunteer for inquiry... Inquiry has to be conducted." The bench declined to interfere with the orders of the <keyword id="6371973" type="UNKNOWN" weightage="20" keywordseo="karnataka-high-court">Karnataka High Court</keyword>, which refused to interfere with the preliminary enquiry ordered by the CCI into their alleged anti-competitive practices. The top court emphasized that the CCI inquiry must go on. However, the court accepted the request made by senior advocate Abhishek Manu Singhvi for extending the time for the companies to reply to CCI. The e-commerce companies had moved the apex court challenging the Karnataka High Court order. The bench said it sees no reason to interfere in the high court order, and seeing that time granted is expiring on 9 August, "we extend it by 4 weeks". On July 23, the Karnataka High Court dismissed the plea by Amazon and Flipkart against a probe initiated by CCI for the alleged violation of competition law. A division bench comprising justices Satish Chandra Sharma and Natraj Rangaswamy passed the order on a batch of appeals moved by the e-commerce companies challenging a June 11 order passed by a single judge of the high court. The bench noted that by no stretch of imagination the inquiry can be quashed at this stage and the appellants shouldn't be afraid of investigation by CCI. The bench said: "In the considered opinion of the court, appeals filed by appellants are devoid of merit and deserved to be dismissed..." Amazon had moved Karnataka High Court against a CCI order which had called for a director general (DG) level investigation into allegations of anti-competitive conduct in the online sale of smartphones on its platform. The Delhi Vyapar Mahasangh (DVM), the informant before the CCI, had alleged predatory pricing, deep discounting, preferential seller listing, and exclusive partnerships, among others, against Amazon and Flipkart. Supreme Court asks Amazon, Flipkart to volunteer for CCI probe

New Delhi, The Supreme Court on Tuesday asked the Centre to hold discussion with internet intermediaries, including Google, <keyword id="790242" type="COMPANY" weightage="20" keywordseo="WhatsApp">WhatsApp</keyword> and Facebook, to develop a strategy to restrict circulation of rape videos, child pornography and images. A bench headed by Chief Justice S.A. Bobde and comprising Justices B.R. Gavai and Surya Kant noted the submissions of advocate Aparna Bhat, appearing for Hyderabad-based NGO Prajwala. Bhat submitted a meeting, to deal with circulation of obscene content on social media platforms, is yet to be convened by the Ministry of Home Affairs (MHA) involving all the stakeholders since December 2018. Solicitor Tushar Mehta, representing the Centre, submitted before the court the meeting on this matter would take place soon and asked the court not to pass any order. Bhat cited the difference in opinion between the NGO and internet intermediaries on the matter - NGO reckon the content can be blocked at the outset, but internet companies say materials have to be brought to their notice to take action. Bhat said delay in action would eventually make the content go viral. She insisted that the issue of child pornography falls under POCSO (the Protection of Children from Sexual Offences Act) and it's mandatory to report on it. Lawyer N.S. Nappinai, who is assisting the court as <keyword id="525739" type="PERSON" weightage="20" keywordseo="amicus-curiae">amicus curiae</keyword>, suggested artificial intelligence tools could filter obscene content and help in its elimination. In 2015, the apex court had taken the suo motu cognizance of a letter written to the then Chief Justice H.L. Dattu alleging circulation of two rape videos and the video content was submitted in the court in a pen drive. The top court on Tuesday said it will ask MHA to schedule a meeting on this matter. The court asked Bhat to provide a status report to all parties to the case and scheduled the matter for further hearing after four weeks. In 2018, the apex court had said the Centre could lay down standard operating procedure (SoP) to block obscene content involving children.

In a major setback to <keyword id="6354553" type="COMPANY" weightage="80" keywordseo="real-estate">real estate</keyword> major <keyword id="1167828" type="PERSON" weightage="60" keywordseo="Delhi-Land">Delhi Land</keyword> and <keyword id="25455" type="ORGANIZATION" weightage="60" keywordseo="finance">Finance</keyword> Ltd. (DLF), the Punjab and <keyword id="101738" type="ORGANIZATION" weightage="60" keywordseo="Haryana-High-Court">Haryana High Court</keyword> on Wednesday cancelled <keyword id="74452" type="ORGANIZATION" weightage="80" keywordseo="Haryana-government">Haryana government</keyword>'s auction of 350.7 acres of prime land in Gurgaon. The land was allotted to DLF in year 2010, after a bid of Rs 1,703 crore at Rs 12,000 per sq m. 
 
A division bench headed by Justice Surya Kant cancelled the auction on technical grounds. A bunch of petitions had accused the state government of acquiring the land from farmers in Gurgaon’s Wazirabad village for 'public purpose' to develop a recreational project. Later, the land was auctioned to DLF for commercial activities. 
 In 2009, only three realtors: DLF, Unitech and Rajarhat <keyword id="2502877" type="UNKNOWN" weightage="60" keywordseo="IT-Park-Ltd">IT Park Ltd</keyword> had participated in the auction. Later, the bids of Unitech and <keyword id="2502876" type="UNKNOWN" weightage="60" keywordseo="Rajarhat-IT">Rajarhat IT</keyword> Park were cancelled on the basis as they failed to meet the minimum technical requirements, like having developed and managed golf course in the past. DLF was, then, left as the sole bidder; and now it was on this ground the High Court struck down the auction. 
 
The bench, however, upheld the land acquisition process of the state government, directing it to carryout fresh bidding process by inviting international bids from new competitive bidders. The High Court has also clarified that DLF could participate in the bidding process that would be finalized with new terms and conditions by an independent consultant (to be appointed within a month). 
 
The land lies between sectors 42-54 and 43-53 and is behind DLF Phase V. According to the bid condition, the auction-winner had to develop an 18-hole golf course along with low-rise residential units on the land. 
 
It is worth mentioning that the land is considered prime as it is located on the Golf Course Road, which commands highest premium in Gurgaon.
