Television content accounted for 46.6% of all traffic to piracy websites followed by publishing content (books), which accounted for 27.80%; film piracy came next at 12.40% followed by music and software, which accounted for 7% and 6.20% respectively, said the Ankura Piracy Statistics Report 2022. <ul class="summary-list"><li>Donald Trump's expert accountant testified over three days in the New York civil fraud trial.</li><li>He said accountants bear final responsibility for the net-worth statements Trump's on the hook for.</li></ul>In three days of testimony, Donald Trump's top accounting expert at his New York civil fraud trial appeared stumped by one simple math question."How much are you being paid?"The question about consultancy fees was posed by the judge to the key defense witness late Thursday morning, just before he stepped down from the stand."My firm is being paid," answered the witness, Jason Flemmons, a forensic accountant who's a senior managing director at Ankura, an international consultancy firm.The judge, New York Supreme Court Justice Arthur Engoron, adjusted his question."How much of your bill has been paid, and how much has not been paid?" the judge asked. This, too, proved a stumper of a question."It's hard to say," Flemmons answered. "Because, as your honor may know, my firm had a couple of other experts" working for the Trump defense team, he explained."Let's get that on a combined basis, then," the judge suggested."It's hard for me to say," the accountant said again. "I have not been involved in the billing process."Asked what Trump was billed per hour for his work on the case, Flemmons said, "I believe it's $925, but that's the amount my firm bills."One of Attorney General Letitia James' lead lawyers, Kevin Wallace, asked whether the accountant had "an estimate of the amount of time spent" on the case."I don't," Flemmons answered.The next witness to be called, Steven Collins, another Ankura consultant who's an expert in government contracts, had a ready answer. She's seeking to permanently bar the former president and his two eldest sons from doing business in New York.Engoron, in a pretrial decision, already found that <a target="_blank" href="https://www.businessinsider.com/trump-new-york-judge-finds-business-2023-9">Trump's net-worth statements</a> were riddled with fraud. He has ordered that Trump's New York real-estate company, the Trump Organization, be <a target="_blank" href="https://www.businessinsider.com/trump-fraud-ruling-corporate-death-penalty-for-his-empire-experts-2023-9">put in receivership</a> and its assets "dissolved," meaning sold. The order has been appealed and is yet to be fully explained or even partially implemented.Flemmons, a former fraud enforcer for the Securities and Exchange Commission, testified Tuesday that a wide variety of "methodologies" could legally be used in estimating property and asset values. These methodologies could produce net-worth values that differ from each other by "orders of magnitude," he said.On Wednesday, Flemmons conceded on the stand that a decade's worth of Trump's annual net-worth statements contained <a target="_blank" href="https://www.businessinsider.com/trump-gets-beat-up-by-his-own-fraud-trial-expert-2023-11">"glaring" problems</a>. But he said Trump's accountants had the ultimate responsibility for what was in the statements, an assertion that the AG's office and the judge have disagreed with.On Thursday, he was asked by Wallace, the attorney for the AG, about that "orders of magnitude" remark."How are you able to have values that differ by an order of magnitude" that both reflect a property's current value, Wallace asked."Estimated current value is not an exact science," Flemmons said.Testimony in Trump's defense case continues Friday.

<ul class="summary-list"><li>Trump's NY fraud trial just wrapped its tenth week of testimony.</li><li>Of 11 defense experts, two testified for free and the rest charged a total of well over $2 million.</li></ul>Donald Trump and his Save America PAC are being charged well over $2 million by the accounting and real estate experts who've testified for the defense in<a target="_blank" href="https://www.businessinsider.com/trumps-ny-fraud-trial-opens-today-heres-why-still-matters-2023-9"> the ongoing Trump civil fraud trial in New York</a>, according to the experts' own testimony.In all, eleven experts have testified on Trump's behalf since early November in the trial, at which state Attorney General Letitia James seeks more than $250 million in penalties for what <a target="_blank" href="https://www.businessinsider.com/trump-new-york-judge-finds-business-2023-9">the judge has already ruled was rampant fraud</a> in Trump's annual net-worth statements.<a target="_blank" href="https://www.businessinsider.com/trumps-fraud-trial-defense-is-kid-critic-pals-2023-11">Two of these experts testified early on in the defense case, </a>and told the judge presiding over the non-jury trial that they were not getting paid.<a target="_blank" href="https://www.businessinsider.com/trump-fraud-trial-experts-offer-chillaxed-theory-of-asset-valuation-2023-11">The first freebie expert was developer and Trump mega-donor Steve Witkoff.</a> The second was insurance broker and Trump golf buddy Gary Giulietti. Both pals testified that in their opinion, banks and insurers probably paid little attention to their friend's net-worth statements.A total of nine paid experts have also testified for the defense.In questioning during the trial or in prior depositions, lawyers for the state have asked each of these nine experts what they were charging for their time.Based on that testimony, their total adds up, conservatively, to $2.33 million in defense expert fees.<h2>Trump's most expensive expert is making $22.50 per minute</h2>Trump's eleventh and final expert witness wins the trophy for having the highest hourly fee in the group: $1,350.He is New York University professor Eli Bartov, an accounting expert whose testimony has stretched from Thursday into Friday and is still not over.Bartov testified that he has spent roughly 650 hours working as a Trump defense expert; that means he has cost Trump Organization and the Save America PAC at least $877,500.Those 650 hours works out to the equivalent of working a full time, 40-hour week for Trump for four months, on top of his teaching schedule.Bartov testified Friday that in his opinion, banks ignored Trump's net worth statements, which he opined contained absolutely no fraud whatsoever."There is no way they relied on the statements of financial condition when they made their lending decision," Bartov said of Trump's bankers, using the formal term for net-worth statements. "This is pure speculation from someone they hired to say whatever they want," Kevin Wallace, a lead lawyer for the AG, said during Bartov's testimony on Thursday."I am here to tell you the truth!" Bartov snapped back. "You should be ashamed of yourself talking to me like that!"<h2>A decade of fraud</h2>The state counters that banks very much relied on Trump's math, and that, in any event, it is illegal to lie in a financial document.<a target="_blank" href="https://www.businessinsider.com/trump-net-worth-math-even-fuzzier-than-ny-last-alleged-2023-9">Trump's annual net-worth statements contained billions of dollars of lies and exaggerations each year, they allege</a>. These frauds tricked banks into cutting Trump a total of $169 million in interest breaks, they also allege.The trial defendants include Trump, his two eldest sons, and two additional longstanding Trump Organization executives, all of whom conspired in drafting the statements.<a target="_blank" href="https://www.businessinsider.com/trump-worst-day-ny-fraud-trial-thanks-to-defense-witness-2023-11">Trump was at the head of this conspiracy, the AG has alleged</a>.Trump's real estate company and his political super PAC are both footing his bill, Bartov said."I submit my bills, invoices, to the Trump Organization," the professor testified Friday, when asked by defense lawyer Jesus Suarez about how he is paid."Some of it gets paid by the Trump Organization and some of it is paid by Save America," Bartov said. "I got no additional detail that I can show you," he added.<h2>One-stop expert witness shopping</h2>Four of Trump's paid witnesses come from the international consultancy firm Ankura, including accounting expert Jason Flemmons, whose testimony a month ago contradicted what Bartov would say this week.Flemmons <a target="_blank" href="https://www.businessinsider.com/trump-gets-beat-up-by-his-own-fraud-trial-expert-2023-11">testified that there were indeed "glaring" problems in Trump's net-worth statements.</a> Trump's outside accountants were to blame, he said, for any "inconsistencies."The four Ankura consultants account for at least half of the Trump defense's more than two million dollar expert witness bill.<h2>The defense will rest its case next week</h2>Trump <a target="_blank" href="https://www.businessinsider.com/trumps-are-testifying-again-in-the-ny-fraud-trial-2023-11">plans to make an encore trip to the witness stand </a>Monday, this time as a defense witness, his lawyers have promised.Bartov's testimony is expected to resume and conclude Tuesday, after which the defense has said it will rest its case. Lawyers for the state have said they expect to present testimony by at least two rebuttal witnesses.At the conclusion of next week's testimony, the case will go quiet for some three weeks, while both sides prepare written briefs summarizing their arguments.These briefs are due to be submitted to the trial judge, state Supreme Court Justice Arthur Engoron, by December 5.Beyond the $2.3 million being charged by experts, it's unclear how much Trump's fraud trial defense is costing.Anywhere from four to six defense lawyers show up in court on each of the ten weeks of trial days.Christopher Kise, Trump's lead fraud-trial lawyer, <a target="_blank" href="https://www.businessinsider.com/trump-paid-high-3-million-retainer-attorney-rejected-others-nyt-2022-9">is reportedly on a $3 million retainer,</a> though he is also leading the defense in the Mar-a-Lago classified documents case.During the first half of this year, Save America, the pro-Trump super PAC, has paid more than $40 million of the GOP frontrunner's legal battles, which include the New York fraud trial.

The FTC <a href="https://www.washingtonpost.com/archive/business/1993/07/22/ftc-deadlocks-again-in-microsoft-investigation/dd8ce8ed-1d66-4c32-b5af-6334f422e364/?utm_term=.0b59b4ba03b3">ended up deadlocked</a> and the government didn't taken any serious action to combat the software giants' anti-competitive activities until several years later, by which time it had essentially wiped out all rivals in the PC operating system market.The lesson from that episode, Warren-Boulton told Business Insider, is that it's really important to address anti-competitive activity as soon as possible in the tech industry."People are always saying things that 'In tech, don't worry, it will fix itself,'" said Warren, a long-time industry consultant who served as an expert witness for the government in the Microsoft trial. "And the short answer is, no, it doesn't fix itself. Companies can quickly parlay an edge in a market into dominance and then monopoly power. That's what happened in the PC operating system market."If the FTC had acted back then ... we would today have two competing operating systems, and Microsoft would be worth 10% of its current market value," Warren-Boulton said.Warren Boulton is an economist and consultant who has been a thorn in Microsoft's side since the early 1990s, serving as an expert witness against the company in numerous antitrust-related trials. After a stint as the chief economist for the US Justice Department's antitrust division during the Reagan administration, he founded a consulting firm and worked with some of Microsoft's rivals who were urging government officials to scrutinize its market power and how it was maintaining it.It was during that time that he got involved in the DR-DOS case. In the early 1980s, as IBM was preparing to launch its first personal computer, it contracted with Microsoft to have the latter provide an operating system for the new machines. Microsoft came up with MS-DOS, largely by cloning an existing text-based PC operating system called CP/M, which was made by Digital Research. The IBM PC became the standard personal computer, in part because IBM allowed other companies to copy its design and market their computers as IBM-compatible. As such devices took over the market, MS-DOS became the dominant PC operating system, because IBM allowed Microsoft to license it to the PC clone makers.<h2>Microsoft tried to box out rivals</h2>Digital Research tried to get back in the game, creating a competitor to MS-DOS called DR-DOS that promised full compatibility and extra features. But Microsoft moved to thwart Digital Research, pushing PC makers to sign agreements that required them to pay Microsoft a license fee for every IBM-compatible computer they shipped, regardless of whether it had MS-DOS installed on it or not. Not wanting to pay two different operating system license fees, few shipped their machines with DR-DOS.The Federal Trade Commission launched an investigation into Microsoft's operating system dominance in 1989 then widened the probe in 1991. But the FTC couldn't come to an agreement over whether to press charges against the software giant. After deadlocking on a 2-to-2 vote, the commission dropped its probe.The Justice Department later picked up the investigation and <a href="https://www.washingtonpost.com/wp-srv/business/longterm/microsoft/stories/1994/settle071794.htm">got Microsoft to drop its per-processor licensing contracts</a>. But by then, the damage was done. MS-DOS and Windows, which ran on top of it, dominated the market.The per-processor license deals "were extremely effective and basically killed off DR-DOS," Warren-Boulton said. "The FTC basically dropped the ball," he continued.<h2>That was the "crucial moment"</h2>With Microsoft's power unchecked by that case, the company went on to extend its dominance from the text-based operating system market to the one based on graphical-user interfaces with Windows. When Microsoft moved to quash the threat to its Windows monopoly from Netscape's Navigator browser a few years later, government regulators decided they needed to scrutinize its dominance again, which led to the famous antitrust trial.But that case would have been unnecessary, if the FTC had just taken quick action against the company a decade earlier, Warren-Boulton said."That crucial moment, looking back in history, was that FTC decision," he said.Got a tip about the tech industry?
