That yearning has turned commercial surrogacy into a lucrative business with thousands of fertility clinics cropping up across the country. The business of surrogacy tourism is estimated to be worth $2.3 billion per annum. An Indian surrogate can make as much as ₹1.2 million per birth — high income for women who otherwise work as domestic help et cetera. Women from economically backward sections earn 10 years worth their salary by renting their wombs. However, a debate over unethical practices prompted the government to put an end to the exploitation of poor women. The Surrogacy Bill, 2019 is one of the key bills that will be introduced in parliament’s winter session starting from November 18, 2019. The Surrogacy Bill, 2019 The Surrogacy Bill, 2019 aims to ban commercial surrogacy and allow altruistic surrogacy for Indian citizens. Altruistic surrogacy says that surrogates should not be monetarily rewarded. However it covers medical expenses and insurance during the pregnancy. In 2016, the government presented the Surrogacy (Regulation) Bill, 2016 and received several recommendations from the Standing Committee on Health and Family Welfare. Later, the bill lapsed when the Lok Sabha dissolved. The government then replaced the 2016 bill with The Surrogacy (Regulation) Bill 2019 and introduced it in the Lok Sabha on July 15, 2019. No single parent, unmarried, live-in or gay couples please The Surrogacy Bill, 2019 doesn’t allow unmarried, gay, live-in couples or single parents to go in even for an altruistic surrogacy. The couple will have to prove that they are married and one of them medically unfit to reproduce naturally. The bill also prohibits couple having biological children to use surrogacy. “The certificate of eligibility to the intending couple is issued upon the fulfilment of the following conditions: (i) the couple being Indian citizens and married for at least five years; (ii) between 23 to 50 years old (wife) and 26 to 55 years old (husband); (iii) they do not have any surviving child (biological,adopted or surrogate), except if the child is mentally or physically challenged or suffers from a life threatening disorder; and (iv) such other conditions that may be specified through regulations,” said the bill. Surrogate mothers should be close relatives The bill also lays down several eligibility criteria to be a surrogate mother. The bill says surrogate mothers can rent womb only once. And they should have given birth to children before that. Surrogate mothers cannot be a foreign national, or a non-resident Indian. “To obtain a certificate of eligibility from the appropriate authority, the surrogate mother has to: (i) be a close relative of the intending couple; (ii) be an even married woman having a child of her own; (iii) be 25 to 35 years old; (iv) not have been a surrogate mother earlier; and (iv) have a certificate of medical and psychological fitness. Further, the surrogate mother cannot provide her own gametes for surrogacy,” said the bill. A blowback to the IVF centres The bill will be a setback for all the IVF centres in the country which earn millions through facilitating surrogacy. These IVF clinics charge between ₹10-12 lakhs from a couple for an entire surrogacy package. After India legalised surrogacy in 2002, the business of fertility clinics flourished and surrogacy tourism boomed. The country now has 3,000 clinics and then unregulated industry is wider and deeper, spread across the country.

The bill was introduced in the lower house of the Parliament on July 19 and was passed in August 2019. The Transgender Persons (Protection of Rights) Bill, 2019, which claims to protect the rights of transgenders and empower them has also been widely opposed by trans community. The LGBTQ community has been opposing the proposed legislation saying that the bill is violating individual rights. The bill defines trangender as a person whose gender is not the one assigned at the time of birth. It seeks a ‘certificate of identity’ that labels their gender as “transgender”. And if someone from the community seeks to change their gender to male of female, the administrative officer will check for the ‘correctness’ of the revised medical certificate. The bill, which includes trans-men and trans-women, persons with intersex variations, gender-queers, and persons with socio-cultural identities is in contrast with the Supreme Court’s judgement that granted protection rights to transgendered people — including self determination of gender and no mandatory medical certificate. Forced labour, any denial from use of public places, physical, sexual or emotional abuse have been listed as an <a href="https://www.prsindia.org/billtrack/transgender-persons-protection-rights-bill-2019">offence under the proposed bil</a>l. If challenged, the penalties include imprisonment of six months to two years, along with fine. The bill says that transgenders should not be discriminated against in terms of employment opportunities. However, it does not include reservations for the community either. The Maintenance and Welfare of Parents and Senior Citizens (Amendment) Bill, 2019 The Bill aims to make life easier for senior citizens by amending the existing act to make it contemporary as per the changing socio-economic needs. The Personal Data Protection Bill 2019 The Bill if it turns into a law will protect and regulate all aspects of personal data, and promote the growth of digital economy. The Dam Safety Bill, 2019 As the country suffered through many floods this year, the bill intends to manage its dams better. The Inter-State River Water Disputes (Amendment) Bill, 2019 It provides for a permanent tribunal with multiple benches and a Dispute Resolution Committee for adjudication of inter-state river water disputes. The fertility-benefits company <a href="https://markets.businessinsider.com/stocks/pgny-stock">Progyny has seen its stock soar</a> by 29% this year, while the S&amp;P 500 has risen about 12%. The fertility-financing startup Future Family nabbed a<a href="https://www.axios.com/2022/04/04/future-family-fertility-care-raises-25-million" target="_blank" rel="noopener"> $25 million</a> Series B in April 2022, while the fertility-benefits firm Carrot Fertility raised<a href="https://www.get-carrot.com/blog/whats-next-for-carrot-after-our-75m-series-c-raise" target="_blank" rel="noopener"> $75 million</a> in Series C funding in November 2021.<h2>Selling fertility insurance</h2>Startups such as Progyny that focus on helping companies offer fertility benefits, rather than on providing medical care, can be attractive to investors because there's less risk involved. The startups get paid via contracts with employers and don't foot the bill for any emergency healthcare costs from pregnancy or births.For employers, fertility benefits can be an attractive perk in a <a href="https://kenaninstitute.unc.edu/kenan-insight/labor-supply-inside-the-tight-labor-market/" target="_blank" rel="noopener">tight labor market</a>. And some fertility companies are trying to stand out further by saying they can lower costs for employers.Progyny, for example, encourages patients to make evidence-based decisions about their fertility care, which helps them avoid expensive emergencies like premature births. In an economic downturn, minimizing employers' healthcare costs becomes an even bigger selling point for fertility benefits.On the other hand, fertility clinics face no shortage of patients willing to shell out, either out of pocket or using fertility benefits, to build their families. So while a startup may run up greater operating costs by providing fertility clinics, the potential returns look much greater, too.For Kindbody, which provides both fertility insurance and clinics, "the dollar revenue and profit per procedure is going to be much higher, because you have almost the entire pie as opposed to just a slice of it," Cantor Fitzgerald's James said. <h2><div type="image" title="Kindbody CEO Gina Bartasi" height="3366" width="4480" msid="100937498" hostid="261"></div>Full speed ahead</h2>Fertility companies are capitalizing on the industry's surge to expand further.Many fertility practices in the US are currently <a href="https://pubmed.ncbi.nlm.nih.gov/34538462/" target="_blank" rel="noopener">owned</a> by private-equity firms — about 15% of fertility clinics were private-equity affiliated in 2018, per a Centers for Disease Control and Prevention report, and private-equity firms have made <a href="https://www.axios.com/pro/health-tech-deals/2022/04/13/kkr-fertility-treatment-ivirma-womens-health">more acquisitions</a> since then. For Jovanovich, having MRKH meant her uterus was underdeveloped and she was unable to get pregnant, she said."It was sad," Jovanovich said. "But it didn't get really sad until I was old enough to start having babies and was in relationships where having babies was being brought up. That's when it was really devastating to me."Jovanovich said she and her husband Jake were heartbroken after a surrogacy attempt fell through in early 2019.
