High security is a feature that everyone values on their devices. We do want our photos and messages protected and away from prying eyes. But, what if an unlocked device could help solve a case by extracting information that could be used as proof? Apple prides itself on the high security of its devices but when it comes to an ethical standpoint, they seem to be on dodgy footing. The latest in their we-are-not-going-to-do-this list came when the Cupertino-based company refused to help <keyword id="3658" type="LOCATION" weightage="20" keywordseo="India">India</keyword>’s Central Bureau of Investigation (CBI) by unlocking Narada News CEO’s <keyword id="6354606" type="COMPANY" weightage="20" keywordseo="iPhone">iPhone</keyword>. The series of sting operations conducted by <a href="https://indianexpress.com/article/what-is/narada-sting-operation-case-everything-you-need-to-know-trinamool-congress-mamata-banerjee-4579097/">Narada</a> News in West Bengal on <keyword id="399454" type="PERSON" weightage="20" keywordseo="All-India-Trinamool-Congress">All India Trinamool Congress</keyword> (AITC) politicians in 2011, exposed the political party’s ‘corrupt’ practices and has since been under the CBI probe. Conducted by Narada’s CEO Matthew Samuel for <keyword id="550113" type="COMPANY" weightage="20" keywordseo="Tehelka">Tehelka</keyword> Magazine, the footage was released just days before the 2016 Assembly Elections in the state. The AITC had claimed that the money that was shown exchanging hands was for ‘donations’ and nothing more. The party went on the win the elections that year, but the investigations went on. According to the latest <a href="https://www.gadgetsnow.com/tech-news/apple-says-no-to-cbi-wont-unlock-narada-ceos-iphone/articleshow/64597506.cms">reports</a>, Apple refused to share the password of Samuel’s iPhone 4s that was used to record the 28-minute long footage of AITC politicians allegedly accepting bribes. The report states that Apple got in touch with the agency through the ministry of external affairs, to inform them that it was against their policy to share ‘personal details’ of a client and that they are not willing to violate that principle. The company did confirm, however, that the footage was shot on the iPhone submitted to the agency by Samuel. Apple’s refusal essentially means that the CBI have no way to match the original footage from Samuel’s phone with the one submitted by him. The AITC had challenged the authenticity of the Narada tapes when the case came up for hearing at the <keyword id="6364869" type="ORGANIZATION" weightage="20" keywordseo="calcutta-high-court">Calcutta High Court</keyword>, stating that it could not be ascertained without the original device. The CBI now have Samuel’s iPhone, but with Apple refusing to share the password, they will possibly have to figure out some other way to access the footage on the phone. This, however, isn’t Apple’s first tussle with security agencies. After a face-off with the FBI over unlocking the <a href="https://www.theverge.com/2016/2/17/11036306/apple-fbi-iphone-encryption-backdoor-tim-cook">San Bernardino shooter</a> Syed Farook’s iPhone and then apparently offering to help unlock the <a href="https://www.theverge.com/2017/11/8/16626452/apple-fbi-texas-shooter-iphone-unlock-encryption-debate">Texas shooter’s</a> phone, the company can’t seem to avoid controversy when it comes to security outfits and how it can and should help fight crime.

Apple refuses to unlock an iPhone for India’s top investigative agency

During hearing a 2009 contempt case against advocate <keyword id="6368850" type="DEFINITION" weightage="20" keywordseo="prashant-bhushan">Prashant Bhushan</keyword>, the <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Tuesday observed that it is not only question of punishment but also faith in the institution that required detailed hearing and referred the matter to an appropriate bench. The contempt case is in connection with Bhushan's comments on the judiciary during an interview to the Tehelka magazine in 2009. A bench headed by Justice Arun Mishra told senior advocate Rajeev Dhavan, representing Bhushan, that he must ponder that people come to court for relief, and when that faith is shaken then there is a problem. Senior advocate Kapil Sibal, appearing for journalist Tarun Tejpal, contended before the bench that people come to court for justice and relief. "We will come and go but the institution exists forever. We must protect the integrity of the institution," submitted Sibal. The bench said let the matter be listed on September 10 before an appropriate bench by the Chief Justice. "I am short of time. I am demitting office," Justice Mishra observed, who is scheduled to retire on September 2, citing the matter requires detailed hearing. During the hearing, the top court observed that in this case in addition to the Attorney General, the assistance of some amicus is also required. Dhavan asked the bench to issue notice to the Attorney General. "Let us leave this to an appropriate bench," Justice Mishra noted. Supreme Court refers Prashant Bhushan's 2009 contempt case to another bench

The <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Thursday asked Attorney General K.K. Venugopal to assist the court in the <keyword id="9820120" type="UNKNOWN" weightage="20" keywordseo="2009-contempt-case">2009 contempt case</keyword> against Advocate <keyword id="6368850" type="DEFINITION" weightage="20" keywordseo="prashant-bhushan">Prashant Bhushan</keyword> for his remarks in the Tehelka magazine. A bench comprising Justices A.M. Khanwilkar, Dinesh Maheshwari and Sanjiv Khanna directed that the case record of the 2009 contempt case should be sent to AG. Senior advocate <keyword id="377410" type="PERSON" weightage="20" keywordseo="Rajeev-Dhavan">Rajeev Dhavan</keyword>, representing Bhushan, submitted before the bench that in the previous hearing the AG had shown inclination to assist the court in the matter, and thus he should be impleaded as an amicus curiae. The bench replied that the AG would be impleaded in the case in accordance with the Rule 10 of the Supreme Court Rules, and the decision to appoint him as an amicus-curiae in the matter will be taken later. Dhavan contended before the bench there are more questions of law, which should be framed in the case, as 10 questions have already been framed. He added that the court wanted to add three more. After a brief hearing on the matter, the bench said it will take up the case in the week commencing from October 12. Supreme Court ropes in Attorney General to help in 2009 contempt case against Bhushan

The <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Monday framed a larger question during the hearing of the 2009 contempt case against advocate <keyword id="6368850" type="DEFINITION" weightage="20" keywordseo="prashant-bhushan">Prashant Bhushan</keyword>. It asked when could corruption allegations against the judges be made public? A bench comprising Justices Arun Mishra, B R Gavai and Krishna Murari posed the following questions -under what circumstances, public statements in connection with corruption of judges can be made, and what procedure should be adopted if such statements of corruption were made in public against sitting as well as retired judges? In 2009, Bhushan, in an interview to Tehleka magazine alleged that at least half of the last 16 Chief Justices of India were corrupt. Senior advocate Kapil Sibal, representing journalist Tarun Tejpal, sought a quietus to the case. Senior advocate Rajeev Dhavan, representing Prashant Bhushan, also agreed on closure on the case, but argued that one cannot go to the press, is a bad decision and needs a review. The bench noted that putting a quietus is not the issue and cited the questions. "We want to hear, because if the questions are left then it will not be better for later on", noted the bench. Dhavan contended that questions are meaningful, and they should be considered by a larger bench. Justice Mishra replied that this aspect would also be considered. The top court adjourned the matter till August 24. Supreme Court to hear 2009 contempt case against lawyer Prashant Bhushan

<ul><li>Activist and lawyer <keyword id="6368850" type="PERSON" weightage="20" keywordseo="prashant-bhushan">Prashant Bhushan</keyword> has rejected <keyword id="6360390" type="COMPANY" weightage="20" keywordseo="the-supreme-court">the Supreme Court</keyword>'s offer to delay the verdict on the Twitter case against him by another two to three days. </li><li>Bhushan told the bench that he does not wish to reconsider his statement or issue an apology.</li><li>The Supreme Court also rejected Bhushan's plea to defer the hearing in order to file a review plea against the verdict.</li><li>The Attorney General asked the bench to not punish Bhushan at all. </li><li>The bench asserted that it is not possible until Bhushan changes his stance and apologises. </li><li>Has been given another two to three days to reconsider his statement.</li></ul>Activist and lawyer Prashant Bhushan has been in a spot of trouble after two of his tweets made headlines for criticising the judiciary and the Chief Justice of India. India's top court ruled his comments to be in contempt of the court and rejected Bhushan's plea to defer the hearing in order to file a review against the verdict delivered on August 14. It is unlikely that there will be any substantial change in my statement," he said. "As regards to giving time, I don't think it will serve any purpose," he added. Nonetheless, the court has deferred sentencing by another two to three days. The AG subsequently requested for Bhushan to not be punished at all. However, the court maintained that it cannot consider that request until Bhushan reconsiders his earlier stance and apologises for the tweets. Supreme Court rejects Bhushan's plea The Supreme Court also refused Bhushan's plea to defer the hearing that will decide his judgement. According to Justice BR Gavai, Bhushan can file a plea to review the case regardless of whether a sentence is delivered today or not. “Even if we punish you, it won’t be activated until the decision on review. We’ll be fair to you. We feel you are trying to avoid this bench,” said the <a href="https://twitter.com/ANI/status/1296327206453432321">Supreme Court</a> in its decision as Bhushan's representation, Dushyant Dave, pushed for the matter of punishment to be considered by a different set of judges. <div type="Article" hostid="261" msid="77633203" title="Prashant Bhushan is seeking deferment of hearing on sentence until the Supreme Court considers the review plea" mstype="2" mssubtype="0"></div> Sentencing Prashant Bhushan for critical tweets In rolling out its sentence in the case against Bhushan and his tweets, which were critical of India's judicial system, the bench noted that it has taken Bhushan's contributions — pro bono cases — into consideration. However, it added, "The fact you are doing many good things does not mean that your wrongs can be neutralised." The AG pointed out that he has a list of five Supreme Court judges saying that democracy has failed within the system. He also has extracts of statements from retired judges that can attest that there was corruption in higher in the judiciary. Large questions of the 2009 <keyword id="61723" type="PERSON" weightage="20" keywordseo="contempt-case">contempt case</keyword> The Supreme Court said it would consider certain larger questions in the 2009 contempt case against Prashant Bhushan and journalist <keyword id="119513" type="PERSON" weightage="20" keywordseo="Tarun-Tejpal">Tarun Tejpal</keyword> as the issue before it has wide ramifications. The top court said it would like to hear arguments from the lawyers as to what should be the process which should be followed in contempt cases where allegations are being levelled against judges. A three-judge bench headed by Justice Arun Mishra said it would like to hear the counsels on whether such statements can be made and the procedure to be adopted for dealing with them. The apex court in November 2009, had issued a contempt notice to Bhushan and Tejpal for allegedly casting aspersions on some sitting and former top court judges in an interview to a news magazine, Tehelka. Tejpal was the editor of the magazine. Bhushan told the court on Sunday that making corruption charges against the judges would not amount to contempt of court and mere utterance of corruption charge could not be contempt of court. The top court asked senior advocate Rajeev Dhavan, appearing for Bhushan, <keyword id="335945" type="PERSON" weightage="20" keywordseo="Shanti-Bhushan">Shanti Bhushan</keyword> and <keyword id="30182" type="PERSON" weightage="20" keywordseo="Kapil-Sibal">Kapil Sibal</keyword> to address it on three issues— whether such statements can be made, in what circumstances they can be made and what is the procedure to be adopted with respect to sitting and retired judges. The journalist told a superior that <a>Tarun Tejpal</a>, 50-year-old founder of the award-winning weekly <a>Tehelka</a>, had assaulted her twice in a hotel elevator during a conference in the resort state of <a>Goa</a> this month.
The investigation into Tejpal, who denies the accusations, has dominated headlines in <a class="cite">India</a> for 10 days as news outlets follow every twist and turn, and follows similar accusations by an intern against a retired <a class="cite">Supreme Court</a> judge.
"He (Tejpal) has formally been arrested and will be produced before a designated court within 24 hours," Dr. <a class="cite">O.P. Mishra</a>, <a class="cite">Goa</a>'s deputy inspector general of police, told Reuters.
Police have studied closed-circuit video footage from the hotel to establish what happened, but there were no cameras in the elevators, a spokeswoman for <a class="cite">Goa</a>'s chief minister said last week.
In a leaked email to the magazine's management, Tejpal said that an "unfortunate incident" had occurred between himself and the journalist, describing it as "a bad lapse of judgment".
The case has triggered a media debate about silence over the harassment of women at their places of work.
It is also seen as a test of a tougher law on crimes against women that was adopted after a 23-year-old woman was gang-raped on a moving bus in <a class="cite">Delhi</a> last year, beaten and then pushed out onto the street along with her male companion.
She died two weeks later amid an outpouring of anger across <a class="cite">India</a>. Four men were sentenced to death while a teenager was sentenced to juvenile custody.

<ul><li>In an interview with Business Insider India, <keyword id="7420771" type="UNKNOWN" weightage="20" keywordseo="Naaz-Joshi">Naaz Joshi</keyword>, revealed her journey of becoming three-time Miss Diversity 2018 in India. </li><li>She was abandoned at the age of 7 and gang raped at the age of 11. </li><li>Despite all these odds, Naaz sponsored her own education and studied fashion design at the National Institute of Fashion Technology (NIFT) however found it difficult to land a job at design houses. </li><li>She went under sex reassignment surgeries in 2013 and started her career in modelling. </li><li>Her next endeavour is to push for legal marriages for the LGBTQIA+ community. </li></ul>Aizya Naaz Joshi created history when won the Miss Diversity 2019 pageant for this third time, at Port Louis in Mauritius.  "My father still is not accepting me. He strongly believes that I have brought shame to the society and the family. He asked me not to use his last name," Naaz told Business Insider India. ‘I had no idea what rape even meant.’ Naaz was born a transgender to a multicultural family. Her mother is a Muslim while her father is a Hindu. In spite of having a twin brother and another younger brother, and she was always the odd one out. "When I grew up a little,all the relative told my parents to send me to the trans (hijra) community. But they declined it and wanted me to study,” she says. Yet, they did not want Naaz to stay with them either, so they sent her away to an uncle in Mumbai. The hardworking youngster took up a job at a restaurant where she washed utensils and cleaned tables. All was well until a male cousin raped her when she was 11 years old. "The sad part was that I had no idea what rape even meant. I got to know much later. All I remember is that I was brutally injured.” By the time she realised, it was too late to find a legal battle as evidence was lost with time. The government is fighting an uphill battle to reduce abuse against women, but sexual violence against transgenders is all but ignored. One of the grave indiscrepancies is with punishment. While those who abuse women could be jailed for seven years or more, in the case of transgenders it is <a href="https://www.scmp.com/week-asia/society/article/2154077/india-no-country-transgender-women">defined as physical abuse and punishments range from 6 months</a> to two years. Education failed to become the passport to future Naaz had hoped that education will sort her life. At the age of 12, she started working at a dance bar in Mumbai to support her education, when they were still legal.

 She had encountered other trans women who danced at the bar. Despite all these odds, Naaz sponsored her own education and studied fashion designing at the National Institute of Fashion Technology (NIFT). She later completed her MBA in marketing from IMT Ghaziabad. "Despite working for big labels like Ritu Kumar and Ritu Beri, I found it hard to get a job," she says. She even pursued a diploma to become an air hostess. Even with a stellar resume and being a NIFT topper, she was forced to take up a job at a massage parlour in South Delhi. “As soon as they get to know about my gender, they used to ignore me,” she laments. As many as 89% of <a href="https://timesofindia.indiatimes.com/india/left-alone-just-2-of-trans-people-stay-with-parents/articleshow/65380226.cms">qualified transgenders in India do not find employment</a> in India.  Even when they are hired, transgenders face the problem that most women do, a blaring pay gap. And for transgenders, the pay difference is as deep as 191%. In her chosen field however, women make more money. "If companies pay ₹35,000 to a female model for a ramp walk or shoot, then it is likely that a trans woman with experience will get only ₹12,000," she informs. A fresher usually earns ₹5,000 for a shoot and if you are a woman with experience in the fashion industry it can go up to ₹35,000 but a trans women with years of experience still earns merely ₹12000. While, the pay hike is 600% for a women, the pay is generally only 140% more for a trans women.

 The treatment that she receives isn’t great either. "The companies pay us little, they behave like they are doing us a favour by featuring us," she says. Naaz wishes that people would treat her like any other women. The Miss Diversity also doubles as a social activist to raise awareness about HIV among women and children. She plans to visit villages near Delhi on September 6 to create awareness on <keyword id="6362797" type="UNKNOWN" weightage="20" keywordseo="section-377">Section 377</keyword> and the importance of a socially inclusive society. Her next endeavour is to push for legal marriages for the LGBTQIA+ community.
