After carrying out a set of amendments and proposing another set last week, the <keyword id="159799" type="General" weightage="50" keywordseo="union-environment-ministry" source="Orion">Union Environment Ministry</keyword> on Wednesday carried out yet another set of changes to the Environment Impact Assessment (<keyword id="61873" type="General" weightage="80" keywordseo="eia" source="Orion">EIA</keyword>) notification of 2006. A major amendment among others is that the Centre will now exercise the power to assess and grant environmental clearance (EC) to the projects under national defence or security importance, instead of the state. "All the projects in category 'B', relating to the national defence or strategic or security importance or those as notified by the Central government on account of exigencies such as pandemics, natural disasters or to promote environmentally friendly activities under national programmes or schemes or missions or such projects which are inordinately delayed beyond the stipulated timeline as laid down in the <keyword id="499053" type="General" weightage="100" keywordseo="eia-notification" source="Orion">EIA notification</keyword> and also meet the criteria as laid down in this regard from time to time, shall be considered at the Central level as category 'B' projects," read the amendment notification. As per the original EIA notification of 2006, the <keyword id="13665941" type="General" weightage="50" keywordseo="state-environment-impact-assessment-authorities" source="Orion">State Environment Impact Assessment Authorities</keyword> (SEIAAs) were constituted under relevant sections and sub-sections of the Environment (Protection) Act, 1986 for implementation of the EIA Notification, 2006 at state level for exercising delegated powers to consider and grant ECs for all proposals under Category B (as mentioned above). Stating that the SEIAAs have gained substantial experience over the past 15 years in the EC appraisal process and the process at the state level has also been made completely online through the PARIVESH portal for efficient and transparent disposal of EC proposals, the <keyword id="151298" type="General" weightage="50" keywordseo="ministry-of-environment" source="Orion">Ministry of Environment</keyword>, Forest and Climate Change said: "The Central government deems it necessary to further de-centralise the EC process for facilitating clearances at state level." But category B projects being those related to defence or strategic importance have "significant element of security involvement" and yet are being appraised at the state level, the <keyword id="48413" type="General" weightage="80" keywordseo="ministry" source="Orion">Ministry</keyword> said, and added: "The Central government deems it necessary to be appraised centrally taking into account national security concerns." Citing relevant clauses, it also dispensed with the requirement of notice "in public interest" while carrying out the amendments in the EIA notification of September 14, 2006. Earlier on April 14, the Environment Ministry had amended the EIA notification for extending validity of ECs to hydro-power and nuclear projects among others. The amendments include revising EC validity for hydropower projects - also termed as river valley projects - to 13 years (plus two years after consulting the Expert Appraisal Committee), 15 years for nuclear projects; 30 years for mining projects, extendable by 20 years and 10 years for other projects, such as townships. Prior to that, on April 12, the Ministry had published a set of proposals to amend the same EIA notification seeking exemption of EC to several projects, including defence related/border areas projects, those up to 25 MW thermal plants based on biomass or expansion of terminal building of airport. Environment Ministry further amends EIA notification in the name of 'national security'

The high court in its judgement of June 30 had extended till August 11 the date for giving comments and objections to the draft EIA. It had also directed that the notification be published in all the 22 languages within 10 days of the verdict. The June 30 order had come on the plea moved by environmental conservationist Vikrant Tongad. The Centre had moved an appeal before the Supreme Court against the high court decision. However, the plea was withdrawn after the apex court asked the Centre to first seek a review of the decision. The Supreme Court, while giving the liberty to the Centre to move the high court, also put on hold any contempt proceedings against the government till it files a review plea. Draft EIA 2020: Centre seeks HC review on direction to publish draft in 22 languages

<ul><li>The <keyword id="61873" type="ORGANIZATION" weightage="20" keywordseo="EIA">EIA</keyword> draft notification is seeking to overhaul the norms governing environmental clearances granted to all kinds of development and industrial projects in the country. </li><li>Nearly 50 environmental groups and activists from Himachal Pradesh have opposed this draft notification. </li><li>Experts argue this notification has been amended several times in the last two decades in favour of 'easing the norms' for business. </li></ul>The threat of climate change is real and it is here. However if one has to go by the latest proposal of the <keyword id="401027" type="PERSON" weightage="20" keywordseo="Environment-Impact-Assessment">Environment Impact Assessment</keyword> (EIA) draft, we are setting ourselves up for a severe crisis. This new proposal, if it goes through, will bring about a landmark change in the way that clearances are obtained in India, and dilute environmental protection in the country. With the deadline to submit suggestions for the draft Environment Impact Assessment (EIA) policy just a day away, we take a look at why this proposal is at the centre of many controversies and why critics want the government to withdraw it. What is draft EIA 2020 proposing? The EIA notification, first issued in 1994, makes it mandatory for project developers not only to study the socio-economic, ecological and other impacts of a proposed project but also place them in front of the affected communities for their opinions and objections. The latest draft has raised concerns because it will render the EIA process as a mere formality. Here are some of the proposals that have raised a red flag: <ul><li>To allow for post-facto approvals, for projects that have been started illegally </li><li>Over 40 industries have been exempted from public consultation and the EIA process. This includes petroleum, mines, dams, highways etc. </li><li>Restricts the role played by experts and scientists in the clearance process </li><li>To allow digital environmental clearances that could compromise the due diligence process </li><li>No wildlife clearance is required for projects which do not need environmental clearance </li><li>Prior wildlife clearance will be required by projects located within 10 km of national park/wildlife sanctuary where eco-sensitive zone (ESZ) has not been notified and which need environmental clearance. </li><li>It also said that NBWL's standing committee approval will be required for projects that are located in areas linking one protected area to another like tiger reserves. </li></ul>However, experts argue, this notification has been amended several times in the last two decades in favour of 'easing the norms' for business. They also reckon that this draft misuses the power given to the central government by the Environment Protection Act, to take any measures to “protect and improve the quality of the environment.” Draft EIA 2020: The arguments against it Congress leader <keyword id="5268" type="PERSON" weightage="20" keywordseo="Rahul-Gandhi">Rahul Gandhi</keyword> on Sunday urged people to protest the new Environment Impact Assessment (EIA) 2020 draft, saying it was "dangerous" and if notified, the long term consequences will be "catastrophic". The turf between the government and critics got ugly when local authorities in Delhi <a href="https://thewire.in/environment/fridays-for-future-website-block-eia-prakash-javadekar-uapa">blocked the content of the website Fridaysforfuture.in</a> — an Indian version of the global youth campaign run by Greta Thunberg — citing that the website is “dangerous for the peace, tranquillity and sovereignty of the (sic) India.” The Fridays for Future India had launched a virtual campaign against EIA norms — which allowed people to send their argument to Union Minister Prakash Javadekar. These are not the only people criticizing EIA. <a href="https://india.mongabay.com/2020/03/indias-proposed-overhaul-of-environment-clearance-rules-could-dilute-existing-regulations/">Environment Lawyer Ritwick Dutta told Mongabay India</a> that the draft is not in line with the principles of environmental protection. “Instead of focusing on ensuring the protection of the environment, the draft EIA 2020 undermines the orders of the National Green Tribunal which had ruled against post-facto approvals. The purpose of this notification is to legitimise illegalities done by industries. It seems to be emphasizing that an industrial project that has violated environmental rules will have a right to seek approval for it as long as that project is permissible in the area. "The reduction of the time prior to public hearing from 30 to 20 days is also highly objectionable. In the given 30 day period itself, the information about public hearings does not reach all the affected people which are often spread out widely in case of mountains with some project-affected communities residing in remote and inaccessible terrains," Green activists wrote in a letter to the government. Another activist, Prakash Bhandari of Himdhara Collective said it was shocking that the amendments include allowing post-facto clearance, which means that the project proponent can start work before they have obtained environmental clearance. Assam Congress president Ripun Bora too urged the Centre to withdraw the draft Environment Impact Assessment (EIA) 2020, saying that it exempts a long list of projects from public consultation. “Linear projects such as roads and pipelines in border areas will not require any public hearing and this would cover much of the Northeast India, which is a repository of one of the country's richest biodiversity,” Bora said in a letter to the Secretary of the Union Ministry of Environment and Forest What is EIA? Environmental Impact Assessment (EIA) is a process of evaluating the likely environmental impacts of a proposed project or development, taking into account inter-related socio-economic, cultural and human-health impacts, both beneficial and adverse. On March 23, this year, the Ministry of Environment, Forest and Climate Change (MoEFCC) published a draft notification on Environmental Impact Assessment and sought objections or suggestions from members of the public. However, due to the COVID-19 pandemic, the government extended the notice period until June 30 initially. India’s Environment Impact Assessment draft is vexing a lot of people — these are the arguments against it

The cumulative increase in diesel price since June 7 now totals Rs 12.55 per litre. In Mumbai, petrol is priced at Rs 87.19 -- unchanged since June 29, while diesel now costs Rs 80.11 a litre. Prior to June 7, oil companies had for 82 days not revised petrol and diesel prices as they adjusted a record increase in excise duty by the government against the fall in rates warranted due to international oil prices slumping to a two-year low. Commenting on oil prices, ICICI Securities said sharp recovery in oil price from lows in April was driven by fall in global supply surplus from 22.7 million barrels per day (bpd) to demand-supply balance in June. "Global oil supply in June fell by 13.7 million bpd from April levels, while demand recovered by 9.1 million bpd during the same period as per IEA. Falling supply and recovery in demand led to demand-supply balance in June vs supply surplus of 22.7 million bpd in April," it said. It said lockdowns due to the second wave of infections have hurt demand recovery in the US and India. As per EIA data, total US, gasoline and diesel demand decline was steeper in the week ended July 17 than in the preceding 4-6 weeks. "In India, petrol and diesel consumption decline is steeper at 12-21 per cent year-on-year in July 1-15 vs 9-16 per cent in June 16-30," it said. Diesel price nears ₹82 a litre after 15 paise increase

New Delhi, Jun 28 () An environment ministry panel has recommended urgent environmental clearance for expansion of the Centre's RML Hospital, saying new and affordable health facilities were required amid the COVID-19 crisis. The Expert Appraisal Committee of the ministry recommended early this month the clearance of a Rs 463.76 crore project aimed at adding 509 beds to the centrally-located Ram Manohar Lohia Hospital, which is presently doubling up as the nodal centre for COVID-19 patients. "It was opined that in the wake of the crisis caused by COVID-19, the health care service needs, new, affordable and state-of-the-art health care facilities, which have to be provisioned at the earliest in megacities where a large number of COVID-19 cases have been reported," the EAC said in its minutes of the meeting, accessed by . "The EAC, based on the information submitted and clarifications provided by the Project Proponent and detailed discussions held on all the issues, recommended granting environmental clearance to the project, subject to specific conditions," the panel added. The EAC, while making the recommendation, also asked the hospital to ensure that the building design takes into account the guidelines of concerned State Health Department, if any, particularly in the context of the highly contagious diseases like COVID-19. The panel also asked the RML authorities to abide by the water and waste management rules and ensure no felling or transplantation of trees "unless exigencies demand" and plant a minimum of one tree per 80 square meters of land. Formerly known as Willingdon Hospital, the RML Hospital was established by the British for their staff and had only 54 beds. After independence, its control was handed over to the then New Delhi Municipal Committee. In 1954, its control was given to the Central Government of Independent India. At that time, Environmental Clearance (EC) was not required, the document said. The proposed block will have 392 general beds, 51 ICU beds, 66 private beds, 3 Cath Lab, 17 Operation Theatres, 96 OPD Rooms, 60 PG Seats, 20 Departments and a Helipad, it said, adding the Helipad will be used only for the organ transplant patient facility and the VVIP treatment. The project/activity is covered under the category of Townships and Area Development projects under the EIA Notification, 2006 and its subsequent amendments, and requires appraisal at the state level. Due to absence of state expert appraisal committee or SEAC in Delhi, the proposal, however, is appraised at Central level by sectoral EAC, it said. Once the EAC recommends a proposal, the final clearance has to be given by the ministry of environment. "The hospital is providing free health care facilities of OPD, Indoor, Casualty and Emergency services of all common specialities along with free drugs and investigation to patients. "It is proposed to add a Super Speciality-cum-Paid Ward Block under the proposed expansion which will have 509 beds. Post expansion, the built-up area of the hospital will increase from 87,343.72 sqm to 1,55,384.37 sqm and the number of beds will increase from 1469 to 1978," the EAC was told. While granting the recommendation, the EAC noted that regarding Consent to Operate (CTO), the project developer had informed that application for CTO has been submitted to the Delhi Pollution Control Committee (DPCC) in November 2019 which is under process. "It is further informed that the condition regarding the requirement of CTO was given in the Terms of Reference (ToR) dated March 17, 2020, and in the same month, RML Hospital was designated a nodal centre to quarantine and treat COVID-19 patients. "Since then, the project proponent couldn't follow it up with DPCC due to challenges and immense pressure caused by COVID-19. The project proponent assured that they will line up to accelerate the CTO process by providing all requisite information/documents to DPCC once the effect of COVID-19 is reduced in Delhi," it said. "It also ensured that the copy of the CTO will be submitted to Ministry, as soon as the same is issued from the DPCC. COVID: Ministerial panel for urgent environmental clearance of RML Hospital expansion

The Energy Department is testing its Strategic Petroleum Reserve (SPR) in light of the impact the shale boom has had on U.S. petroleum infrastructure. The situation in Ukraine is not mentioned in the DoE's statement. 
The test will include the "drawdown and sale of up to 5 million barrels of sour crude oil," said DoE spokesman Bill Gibbons.
Drawdowns on the SPR are pretty irregular. Here's a list from the DoE:

Oil has already had a rough week, <a href="http://finviz.com/futures_performance.ashx?v=12%20">down 3.5%</a> on expectations of rising U.S. supplies amid reduced demand as refineries undergo seasonal maintenance. It closed at its lowest level in a month yesterday.

<li style="padding-left: 30px;">5 million barrels of SPR crude oil will be offered for sale. Of this, 4 million barrels of sour crude would be offered from the SPR West Hackberry site and 1 million barrels of sour crude would be offered from the SPR Big Hill site.</li>
<li style="padding-left: 30px;">During the sale, crude oil may not be sold at a price less than 95% of market prices for comparable crude being sold in the same area. The price index for price comparison purposes is domestic sour crude sold in the same market center as the sale (Southern Green Canyon crude oil).</li>
<li style="padding-left: 30px;">The release of up to 5 million additional barrels of sour crude into the marketplace through the proposed test sale is expected to have minimal market impact.</li>
<li style="padding-left: 30px;">The Department has been discussing this internally for many months, and the Notice of Sale is being issued today so refineries interested in purchasing crude oil from the SPR can plan accordingly for when their facilities come out of their annual maintenance cycle at Gulf Coast refineries when crude oil stocks are being replenished in preparation for switchover to summer grade gasoline.</li>
<li style="padding-left: 30px;">The Department announced the sale today by issuing a Notice of Sale to those companies who have registered on the SPR Sales Notification List. Contracts will be awarded through a competitive sales process in mid-March for crude oil deliveries in April. Invoices would be issued shortly after deliveries are accepted and receipts for payment would be due no later than 30 days after invoicing.</li>
