As part of its revised selection process, the US has hiked by USD 10 the application fee of the H-1B work visa, the most sought-after among Indian IT professionals. The H-1B programme allows companies in the United States to temporarily employ foreign workers in occupations that require the application of a body of highly specialised knowledge and a bachelor's degree or higher in the specific specialty, or its equivalent. This non-refundable fee will support the new electronic registration system to make the H-1B cap selection process more efficient for both petitioners and the federal agency, said the US Citizenship and Immigration Services (USCIS) on Thursday. "This effort will help implement a more efficient and effective H-1B cap selection process," said USCIS Acting Director Ken Cuccinelli." The electronic registration system is part of an agency-wide initiative to modernise our immigration system while deterring fraud, improving vetting procedures and strengthening program integrity," he said. Upon implementation of the electronic registration system, petitioners seeking to file H-1B cap-subject petitions, including those eligible for the advanced degree exemption, will first have to electronically register with the USCIS during a designated registration period, unless the requirement is suspended, the USCIS said. The federal agency is slated to implement the registration process for the fiscal year 2021 H-1B cap selection process, pending completed testing of the system. It will announce the implementation time frame and initial registration period in the federal register once a formal decision has been made, and the USCIS will offer ample notice to the public in advance of implementing the registration requirement. The USCIS published a notice of proposed rulemaking highlighting a registration fee on September 4, 2019, which included a 30-day public comment period.The USCIS received only 22 comments during that time, and has considered all submissions and offered public responses ahead of announcing the final rule, which is effective on December 9.

It would be the first such fee increase since 2016, but experts and industry insiders say that the timing couldn't be worse, likening the situation to pouring gasoline on a burning fire."We are already operating in an environment where there are very, very few jobs. That would especially affect smaller companies, universities, and startups, which would, in turn, undermine Silicon Valley's innovation pipeline.The proposal is in the middle of a 60-day comment period for people to officially weigh in on the idea. Immigration lawyers are encouraging their corporate clients to submit comments about how this would hurt their ability to hire people on these skilled-work visas. "Businesses are getting back to normal right now right after COVID, and really, I think this could impact the amount of workforce and potentially foreign employees that they want to hire," Cristina Perez, an immigration lawyer at the law firm Leech Tishman, said. "I think that's not a good thing. There's study after study that shows H-1B beneficiaries really are a benefit to this country."<h2>Why the USCIS wants to raise fees — and why experts are skeptical </h2>Experts aren't surprised that the USCIS wants to raise fees, especially since it's been so long since the last increase.Under President Donald Trump's administration, the USCIS attempted to dramatically raise fees for naturalization and looked to collect $50 from asylum seekers. The changes would have also ended many fee-waiver programs for low-income visa applicants. Those changes were blocked in federal court in 2020.The Biden administration is taking a different approach, with the USCIS now saying that it intends to use the $600 in additional fees for specialized visa programs like H-1B to keep the process free for those seeking asylum at the border.<h2>Critics say the fee hikes wouldn't solve any problems</h2>Critics say the planned fee increase would make life harder for visa seekers, without addressing any of the problems with the immigration process, including the massive backlog of visa applicants."Our system is definitely not working. It is not efficient. It is riddled with inconsistencies," Perez said. "Fix the problem first, then raise the fees."Some in the industry hope it starts a discussion about what it takes to retain global talent. Sunny Shuoyang Zhang, a founding partner at Born Global Ventures, said she hoped this could be used to educate employers about what it takes to keep global talent in the US, when they have the option to go places with friendlier immigration policies, like Canada. Rates are discounted for children.However, the annual health surcharge has risen steeply in recent years. How Hong Kong citizens can apply for visas and passports to live and work in the UK

The State Department said those who got a final refusal on their application on or after January 20, 2020 "could seek re-adjudication without resubmitting their application forms or paying any additional fees, provided the underlying visa petitions remain valid."Those who were denied before January 20, 2020, would have to reapply and pay a new application fee. US <keyword id="6355470" type="UNKNOWN" weightage="100" keywordseo="law">law</keyword> bars people who were selected as part of the diversity visa lottery between 2017 and 2020 to be issued visas if they have not gotten them already, the statement said. The Department said while they're working to make sure those impacted can be helped as soon as possible, the pandemic has made it difficult to process visas. "As the Department works to serve affected applicants as quickly as possible, the health and safety of our workforce and customers remains paramount. Those refused entry to the US under Trump's Muslim ban policy can get a new decision, State Department says

The United States has formally notified the increase in H1B and L1 visa fee. Now, applicants will have to shell out additional $4,000 for certain categories of H1B visas post December 18, 2015. 
 
The US Citizenship and Immigration Service (USCIS) said applicants of certain L-1A and L-1B will have to submit an additional amount of $4,500. 
 As per the Consolidated Appropriations Act, 2016, signed into law by <keyword id="67474" type="UNKNOWN" weightage="20" keywordseo="US-President-Barack-Obama">US President Barack Obama</keyword> on December 18, 2015, additional fees has to be paid by petitioners who employ 50 or more employees in the US, with more than 50 per cent of those employees in H1B or L (including L-1A and L-1B) non-immigrant status. 
 
This will remain effective through September 30, 2025, USCIS said. 
 
In a statement, USCIS warned that it will begin rejecting H1B and L1 visa petitions received on or after February 11, 2016 that do not carry the information required under the new law. 
 
USCIS has also revised the necessary forms in this regard. 
 
During the 30-day period immediately following this web alert, USCIS may issue a Request for Evidence (RFE) to determine whether the additional fee applies to the petition.

The key bottleneck comes in when foreign citizens with a F1 visa — permission to study at an American university — graduate and try to transition to an H-1B visa, which allows those American-educated workers to work in the United States. If someone with an F1 visa can't get an H-1B, they may take their U.S. education back home with them. 
To even <a href="http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=4b7cdd1d5fd37210VgnVCM100000082ca60aRCRD&amp;vgnextchannel=73566811264a3210VgnVCM100000b92ca60aRCRD">apply for the H-1B visa</a>, a person with an F1 student visa needs a job offer in hand, a degree or 12 years work experience, $325, an employer willing to sponsor an H-1B visa and pay between $750 and $1,500 as a basic fee and up to $3,725 in additional fees and no less than seven individual documents. 
Because there are mandatory caps on the number of H-1B visas — <a href="http://www.businessinsider.com/current-immigration-policy-silicon-valley-h-1b-2013-1">functionally 85,000,</a> with few exceptions — many of these highly trained workers are denied permission to work in the United States, despite their abilities to generate value for the economy at nearly no impact to the average American worker.

As a result of caps on H-1B visas, 41,753 full petitions for temporary worker status were denied, withdrawn, or closed over the past four fiscal years.

One major issue for these applicants — and a reason why the CIS stats may underestimate the number of students who want H-1B visas but are unable to get them — are the number of days it takes for the U.S. to hit the cap for H-1B visas. 
Since demand exceeds annual supply, <a href="http://www.h1base.com/visa/work/H1BvisaCapH1BquotaSystem/ref/1568/">the U.S. runs out of H-1B visas sooner and sooner</a> each fiscal year. The H-1B visa "season" begins on April 1st and ends once the U.S. hits the 85,000 cap.
Here's how many days it took for the U.S to run out of H-1B visas each fiscal year (note that the fiscal year is different than the real year, so Fiscal year 2013 is almost over:

The decrease since 2011 is worrisome for firms that rely on U.S. educated foreign-born professionals. 
A year's worth of visas were all issued within two and a half months for fiscal year 2013. Companies that need a consistent inflow of these workers are aiming for a brief visa window that is getting much smaller. 
This also means that the denial rates from the CIS may be an underestimation of the people the U.S. turns away. 
Once the CIS announced that they had run out of visas on June 11, they stopped accepting — and thus denying — visa petitions, meaning that nine and a half months worth of visas are potentially unaccounted for. 
As a result, American companies can't plan for employment as well as they'd like.
