The attorney representing Eric Trump in a fraud lawsuit against the Trump Organization has quit, a court filing showed.

Marc Mukasey of Mukasey Frenchman LLP was one of two attorneys representing Donald Trump's son Eric.

The lawsuit was filed by New York Attorney General Letitia James against the Trump Organization, of which Eric is an executive vice president.

A court filing dated September 14, which was first reported by Forbes, said Mukasey would withdraw his "appearance as counsel of record for Respondent Eric Trump."

Mukasey is a high-profile criminal defense attorney who successfully defended Eddie Gallagher, the former Navy SEAL, against a charge of premeditated murder.

James announced last year that she was taking legal action as part of a civil investigation into whether executives at the Trump Organization falsely inflated the value of its assets to get access to loans and underestimated them for tax purposes.

The legal action was a motion filed in August 2020, partly designed to compel Eric to give testimony after he failed to turn up for a scheduled and subpoenaed interview.

Eric was, James' office said, "intimately involved in one or more transactions under review."

James opened the investigation in 2019 after Michael Cohen, Donald Trump's former personal attorney, testified before Congress that Trump's annual statements inflated the value of his assets in order to secure favorable loan terms and insurance coverage, as well as other benefits.

Insider contacted both Mukasey and the Trump Organization for comment but did not receive a reply at the time of publication.

Eric Trump is expected to continue to be represented by the criminal defense attorney Alan Futerfas, the court filing said.
